I also did googling.. but couldn't get fax# or email of Director @ NSC [GERALD HEINAUER]. It seems not avialble in public domain.

Those cases are void at least per DOS. If you look at last month (or prev 6 months) demand data from DOS .
Demand Prior to Jan1st 2006 for EB2 I/C = 0
Demand data reflects the latest and accurate. (at least this is the document DOS relies on to set the priority date in VB)
Nothing is void, unless the application(i485) is denied. If we compare Oct 2010 inventory with Jan 2011 inventory we see changes in monthly pending cases before 01/01/2006.
DOS look for approvable cases in a particular month, as opposed to USCIS look at overall pending cases.:)
The bottom line is how one is interpreting the data/information available? We really don't know how DOS is interpreting USCIS pending inventory when publishing their demand data.

I am surprised that Capitolone did not accept EAD. I do not see any issues for them with employing somebody on EAD. Personally I think a lot of banks and other financial institutions have been neck deep in losses from the Mortgage melt down and they are laying off staff and put a halt on the hiring. I suspect this might be the case with Capitolone too and may be they do not want to admit it. Once you have an EAD do not stick with one company, apply for multiple opportunities and go with the best offer. I would advise every body with EAD to try and secure a job if they are not working currently, because with the weakening economy this will be a period where the job market will suffer.

So, their fight is primarily geared in support of undocumented (read "Illegal") people.
We already have enough problems educating common people and lawmakers about the differences between legal and illegal immigrants. Let us not add fuel to the fire ourselves.

Its interesting that July 2nd apps have not been receipted yet. I made two applications (based on the same I-140 from TSC because of the July fiasco), one on July 2nd and one on July 19th.
You can see the first application details in my signature. My second app's checks cleared the bank on 09/12/2007. This is the application that reached NSC on July 19th - the receipt is from TSC.

This is just a message to 2005/2006/2007 PD guys. Please don't think that some miracle will happen and dates will be current soon, it will take its own time. Mostly for EB2 & EB3June 2006- June 2007 guys, it will be like a lottery if the PD becomes current somewhere in 2007 Oct-Nov time. Right??
So life is not always easy. There are people waiting since 2002-03-04.

Let's have a look over OCT bulletin after 2 months and for sure dates will move atleast 4-6 months for EB2 guys and 1 year for EB3 guys. So wait, be patient, instead of doing all this.
Anyway, our turn will come sooner or later, so why to become impatient just seeing the JULY bulletin CURRENT and then "U".
Mainly this is the message for 2005-2006-2007 PD guys. Please don't take it otherwise.

There are several people who has to re-file their labor for several reasons (employer greedy, company overtaken, laid-off, company gone bankrupt etc etc.). That does not mean that 2005-2006-2007 guys are asking that they should get GC before 2001-2004 people. What most of the people need is an ability to file for AOS so that they can indepenedent of the clutches of their employers.
I'm sure if you widen your horizon, you will be able to understand the plight of all your brothers and sisters stuck in this retrogression.

Only option that person may have now is to change career altogether in the fields where desi consulting companies do not operate.
Job Zone 4 does not automatically translate to EB3. Even though the title maybe EB-3, if the requirements exceed normal requirements for jobs in Job Zone 4 then after a (successful) business necessity audit the candidate maybe able to file in EB2. After all I don't think DOL is that brain-dead (yet?) to say that somebody with 15 yrs exp is the same as somebody with 1 yr exp although they have the same job title (E.g. Software Engineer title at Google generally has more experience and education than a software engineer title at a desi consulting company even though both fall in job zone 4

For most IT people it is going to be very tough to get EB2 classification (especially if you are just out of school and have decided to apply for a green card). It is better for them to look out for research positions and apply under Computer Scientists as this will atleast enable them to apply under EB2. Is this a good thing: If you are non-IT yes, if you are IT no as it just convoluted the process even more.

Wait a minute, how was this India EB2 case even allowed to file I-485 when that PD has never been current? The lawyer alleges that it has been pending for several years.
Does this "fee bill" have nothing to do with 485 filing? Is it just plain wrong or am I missing something obvious here?
Perhaps he meant September 2006.
In CP process USCIS transfer I 140 / I 130 etc to NVC as soon as they get approved. but they sit there for years before NVC thinks date will be current soon and they send out fees invoice.
I am beneficiary of I 130 ( Family based petition ) and my I 130 at NVC for almost 2 years now. and when my date will come close to current ( in next 10 years ) they will send me fees.
Hope I become US citizen before that......:)

Wow !! They probably did their homework and are prepared to hide behind some loophole in the law to clear themselves of discrimination.
After reading the other thread link that BharatPremi had posted earlier, it seems there is a possibility that they could claim that they don't want to do sponsorship (which is legal to say so), and hiring an EAD candidate means they may have to do some amount of sponsorship, however small it might be (like providing the correct form of employment letter etc).
Interesting policy. A lot of companies do not sponser H1b and GC because of the woes, costs and hastles associated with it, though they would love to hire the right kind of candidate. But this company is ready to pass the right candidate just because they have to provide a letter?

Good Question. AC21 usage introduces a "Chicken Or Egg" situation. Our limitations 1) Till we interfile we have to show us fulfilling EB3 job calssification related obligations ( that also is a "future" postion in reality). Now if EB2 application is from "same employer" then that employer can logically produce the letter matching EB2 level experience after "real and natural skill progression" only to prove that you are fit for more advanced skill level job in other words after wait for 2-3 years.
Many of us could be over-qualified for our current EB3 position (after so many years of wait) and is accepting the current position only to strictly adhere to "same/similar" job classification. In that case employer can file a GC for our real qualification i.e. Eb2.

Well even if you use AP, you need a passport, dont you? And the passport must be with the Consulate pending stamping. So one way to get the passport back is to withdraw the visa application.
A question though: is'nt it abandoning your H1B1 visa tenure if you enter on AP even with a valid H1B remaining?

Hello,
I have heard of the TERM 'Interfiling' to port your priority date from EB3
to EB2. This i hear happens when your 485 is pending with USCIS and
you have an EB2 labour with current PD date. So you transfer the PD using Interfiling.
Any one any thoughts or have you done this ?

Looks like they do not publish the e-mail address to contact congressman. You can send e-mail only through contact your rep system where you can send only to your local rep. If your ZIP code does not match the congressman's district, then you cannot send him the mail. Even to Judiciary committee chairman !!!!!!!!!!!

At present my EAD is status not changed (USCIS case tracking), So I assume my EAD is valid. I also read Attorny Ron's blog that EAD is valid even I485 is denied. That gives me some comfort. Another problem, even if I get H1b (with out I94), I don't have AP to go (out of country) for stamping. What happens if I apply for AP while I485 is denied? Any one tried this? I am not sure what to do...
well, you don't really need AP to go out of country in this case as you are going to stamping. But in case if stamping is denied for any reason, its an end. Unless you specifically received CIS letter stating that your EAD is also revoked, it is probably valid. You can keep working on EAD till CIS works on your appeal or MTR.
