And you need to do better than just posting links to ACLU and other left leaning websites if you want to forcibly argue your point. Somebody in this forum was pointing out how the majority here seem to favor illegal immigrants. Let me point out that Apraio was elected democratically in 1996, 2000, 2004 and 2008. Apparently voters in his county have a different point of view about illegal immigrants and have no problems voting him again repeatedly.

Is IV only for those who have filed I485?
I gave my opinion and people gave me lot of reds. There is a majority here who already have EAD and have filed I485. You people do not care for those who are less fortunate and struggling in the early stages of the process. If July 07 had not happened, all of you would be asking for I485 filing option today.
By giving reds to people who disagree you will drive people away and make IV only for those who have filed I485 and not for the entire EB immigration people.
Firstly, why do you care about reputation on the forums (reds)?
Secondly, did you try the process described by NolaIndia?

Hi, I have a question regarding the exempt cap for non profit H-1. I will graduate with a masters in education in 2008 and already have job offers to work in public schools.
My question was -
- does public school employment qualify under the non profit H-1B exempt category?
- Should I apply under the Masters quota?
Please reply as I have been searching for answers for a few weeks....

H-1B for secondary public schools does not qualify for the non profit H-1B exempt category. But since you have a Masters from the US you will fall under the 20,000 visas slot. Your employer will not have to pay for the H1B training fee of $1,500 at the time of filing. Good Luck!

logically speaking lottery will be applied only on the applications that have crossed the limit. for 20000 MS H1 quota assume on April 4 the numbr of applications recieved is 18000 and on April 5 the number of applications recieved is 4000, then lottery will be held for the 4000 applications to determine the 2000 cases. All applications recieved on and after april 6 will be returned.
This is just my logical reasoning.

Let us say that i agree to what ever you say. In what way does everything you stated above make a STEM graduate eligible for GC without an Employer sponsership. Why does it have to be only STEM graduates which will not need employer sponsership. If giving GC based on completion of MS in us is bypassing the employee sponserhsip then that has to be extended to all EB categories of immigrants (EB1/EB2/EB3) and the benefit o those visas have to be passed to the badly retrogressed category first.

A simpler suggestion would be to permit citizenship after 5 years of continuous lawful residence in the US...drop the word "permanent" from that law, and go straight from L-1 to USC, do not pass LPR, do not spend $10,000!:D
But seriously...It would actually fix a lot of problems for those who want US Citizenship, and because those would no longer apply for immigrant visas, those numbers would be available for those who do not wish to become US citizens.

50,000 unused visas were given to Schedule A in 2005. When the bill was first introduced the unused visas 100,000+ was supposed to go to EB3 since there was retrogression in just EB3 category and Schedule A was part of EB3.
After debate for a few days 50,000 of these were allocated to Schedule A and the EB3 retrogression was forgotten and never been fixed since.
Hope this doesn't happen again.

UNUSED VISAS WERE DUE TO uscis INEFFICIENCY!!! Make sense if they make amends.
