Today I have contacted Ron Gotcher and here is his response.
1. Begin by contacting the office of the Inspector General of the Department of Labor. That office is supposed to ferret out mismanagement and misconduct within the agency. With cases pending as long as they have been pending, something is clearly wrong.
2. If you get no response from the IG's office, next prepare a formal letter to the Secretary of Labor, asking for assistance.
3. If that doesn't work (though it should), next contact the chairs of the House and Senate immigration sub-committees and file formal complaints, requesting their help. If you include a large number of victims, this should impress them enough to contact the agency to find out what's going on and get it resolved.
And also Ron Gotcher ready to help us.
So please guys post your inputs and what can be done futher. Its a collective effort and have to help outselves. Here is the action plan.

I am also eagerly waiting for it.
All of my friends with PD2006 (jan-Mar) got their GCs and I am still here waiting.
2nd FP on July 29th, Raised a SR on Aug 2nd. So far nothing moved, no LUDs.
Tried congressman's inquiry no response yet.
I dont know if I get GC atleast this time or not :mad:

The answer is Yes. Thats how pre-adjudication happens. And when dates become current it gets assigned again to the same or another IO so that the visa number can be assigned to the file.
I am just wondering do they assign it to officer when dates are not current ?

Good to see an EB3 thread with so many people in EB2 getting Greencards these days.
It is a matter of time EB2 I is current and nobody from EB2 will care for EB3. It is comforting that many IV core is EB3 and some good will happen to EB3. A friend of mine with EB3 I PD in 2008 has literally lost all hope of getting greencard and that is very sad. It is painful to see EB2 people not helping EB3 people. Why?

Is the birth certificate required for dependants too or just the principal applicant...Can someone please clarify.....My PD is not current (EB-3 India Nov 2003)..But hoping it will be current in a few months....So just want to keep all docs ready if the dates are current.....

I have a question regarding an appeal I did a year ago for a rejected LC.
I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. Will the completion of the Backlogs Centers help a LC recently submitted? Will my status change if an audit is required? I am just worried for the "30 days" deadline to response to the audit letter. Just in case the letter has been sent to my employer and is still hasn't been open it. :( Am I asking too much if my LC was submitted on 08/06/07?

My daughter aged out a couple of years ago due to the fact that my husband's labor was in process and it took about 2 plus years to get approved. Another thing is we have no options at all because our child is severely handicapped and we came here only to participate in a research and never went back as doctors advised her to stay here due to her health issues. We continue to keep her in legal status by applying for B2 visa all the time and which USCIS has been kind enough to grant it to her based on doctor's letters. I hope something is done for the children who have aged out. I even took up our case through Senator's office but nothing happened. It would be really great if IV could do something for the Aged Out Children and parents. I had to leave the job and get into H4 due to her ill health and be her primary care giver.

Hello All,
I found a unique way to cope with the stress of our immigration nightmare.
I always feared that this long wait to get the status issue settled would kill the entrepreneurial spirit that I have. The burning desire to do my own thing.
I have been trading stocks for the past 4 years or so now but just recently got interested in PDT - Pattern Day Trading (http://en.wikipedia.org/wiki/Pattern_day_trader) (Clickable)
I have found it very interesting as well as rewarding in terms of fulfilling the urge to do something more than what I am doing right now.
It is not easy and it is not for the weak hearted but the rewards are wholesome and tremendous.
I would like people who are interested to "PM" me or post replies here so we can exchange ideas
IMP NOTE: Trading stocks is a type of investment so It is perfectly legal to do so. You do not even require an EAD to do so .
No doubt that if you do have EAD you can trade as business entity as well.

Do not forget to to keep the momentum up at IV and do donate to IV as often as you can .

What is your PD? There is a portion of the memorandum that needs your child's age at the later of the date when PD is current or when petition is approved if PD is current by petition approval date.
I think you should submit an I-485 for your child as soon as possible or if the child is not in the US then file a I-824 immediately. This will serve as proof that your child "sought LPR status" within one year of your PD becoming current. Even if the 485 or 824 is rejected, you have established the fact that your child "sought LPR status" and leave room for administrative appeal in future.
This is just my 2 cents and I am not a lawyer. However, whichever way you interprete the new memorandum your child's CSPA age is under 21.

Today I got welcome letter just for me, but status shows "Decision" since May 2nd for both of us.
Welcome letter says that what I got is a courtesy, original notice has been sent to to attorney. Does it mean the cards will be sent to Attorney as well? My attorney is tough to get hold of, never responds calls or emails.

The biggest weakness of DOL/USCIS is going back to the older cases while newer cases are piling up. They do not have any service level agreements to adhere to. That is why many labors in the older process ended up in BECs.
Please raise this problem with your local senators and representatives and put pressure on DOL. The longer it takes at DOL, the longer it takes for your GC. Do not be under false hopes that your I-485 will be picked up based on the PD. For USCIS, RD is the convenience and they wil only go by that even if the law is written otherwise. So get your application out faster.

i'm all for this. This is very close to my heart. I probably care more about this than i do, my 485 approval.(can't have one without the other, i know i know. But still.).
I don't know when i'll get my 485 approved, hopefully within the next year. But i'm willing to work on this, whatever it takes - contributions, lawmaker meetings, dc.

The intention of the law was to have them learn the language, the ways of the country, and assimilate, which was expected to take about 5 years, before applying for citizenship.
These days the green card process itself take over 5 years for a lot of people. Most indians and chinese in the eb2 category, and pretty much the entire eb3 category have lived here longer than 5 years. In those 5 years they have gone to school here, paid income taxes, bought homes, and learned the language (well they had to, in order to qualify for an employment based green card!). What more "assimilation" do they need to do?
I definitely think that the following should be the criteria for eligibility to apply for citizenship,
- an approved green card
- 5 years of continuous u.s. Residence starting from the date the 485 application was received.
Let's do this.
