After this step "it has to go to Rules Committee and await determinations by the Rules Committee as to how much debate will be allowed and whether floor amendments will be allowed, and if so , how many.
Then both house and senate has to vote on this bill ( if Senate have already one similar to this)
If it passed in both congress then it will go for President signature I guess.

In any case, why should someone be SO disturbed if some lawyer says "I will try to prove your degree equivalency for trying to get into EB2"?
Going by folks' behavior here, I am inclined to think, some simply hate such a lawyer for nothing more than personal interests

One would make contribution only if they have confidence in IV. Today IV have more than 2000 members. Let's join hand and make Immigration Voice stronger by contributing $100 or more one more time.
We have al ready seen that Immigration Voice have shown their ability what they can do with all your help. We have not yet achieve the goals but we are not too far from that. One has to understand that Immigration Voice is an organization owned by you and me and so please contibute so that Immigration Voice can work and solve the retrogression problem.

You need to understand how legal system works. Lawyer can not file lawsuite by himself/herself. It has to come from Employer, that too, when employer's H1-B petition is denied based on memo info or H1-B worker is denied entry. Damages (or Loss) must be shown before a civil suit can be filed.

I am on my 7th yr extension of H1B and my lawyer has told me that once I apply for 485, I can NOT keep renewing my H1B. That is why he insisted on applying for AP.
whats your PD? Is your I-140 approved?
You can get extensions even after the I-485 is filed. The only grey area is if your I-140 is not approved AND your LC PD is < 365 days.
if I-140 is approved, you should get a 3 year extension (AC21 seems to imply you get an extension only if you cant apply for AOS, but USCIS has been interpreting that as if they cant grant you AOS due to PD not being current). A couple of my friends with non current PD and 485 pending for a while have got 3 year extensions

just presenting a possible reason why what paskal proposed in his post does not work well in IV.......its not a question of whether phone calls are important or not....its a question of making a significant number of forum stakeholders (and not 1-2%) get to act on any initiative......fund raising/ calling efforts etc....
i genuinely believe that the core members go above and beyond whats expected to do what they are doing for IV - its truly remarkable...they all have busy lives and it takes great conviction and dedication to take the time out and do this...but why are the people still not responding despite the obvious pitfalls of not acting on GC related initiatives.......
maybe its lethargy, inaction, indifference etc.......but we should be open to considering that just maybe, a vast and silent majority of IVians do not feel a sense of representation in the organization and hence do not react as enthusiastically as they should........legitimacy among the constituents often comes with representation
why did most kingdoms around the world perish and give way to democracies......bcos the kings taxed the public based on their whims and fancies......elected govts may do the same but people still pay up and if they dont agree - they know they have a choice at the next elections.......
and no, i dont deserve to be the CEO - neither do i have a performance track record nor credibility here......should not stop me from voicing a contrarion view though

Nobody here exactly knows why the participation rate is less. Some of reasons could be:
i have my EAD, thats more than enough for me
i am in my I-140 or PERM stage, why should i bother now?
i don't think GC process is a big problem, i am sure i will get one day
i don't care. I will sit and watch others do this for me
I will not blame the core members. I understand their Vision and it aligns with mine. How do you enforce a vision in IV community when the participation is less?
How can any action survive with 100-200 members participation? look at numbersusa and learn from their strengths.
Having said that, i have a few suggestions though. Lets talk to our friends and relativies, understand their concerns/issues and communicate IV's vision to them in a better way and get them to participate.
Lets set some intermediate goals to track our progress.

does this mean that EB3 ROW can't use all available visa for 3rd qtr that is why there were visas available for India EB2 (hence the established cutoff date of Dec 2003). but this should only happen if EB3 ROW is current but it is not.
so my question is how can be available visas to spill over to India EB2 if EB3 ROW is not current and it is still retrogressed???

1. several calls to TSC and one IO in TSC initiated a request for case to be assigned to an IO.
2. The nicest IO i ever met at an INFOPASS at Memphis office. She is the one who really got it done for me as she spoke to TSC IO and insisted my case to be assigned. She also wrote email to TSC asking that case should be assigned as dates are current. There was a problem in Biometrics upload and she got is fixed too.
3. My congressman also called TSC but by the time the Memphis IOs email and call had me approved already.

You make these H1-Bs who have spent 6 years here (working on various products, technologies, ramping up, understanding customers, relationships etc) go back, they are going to start companies in India. Now all the capital stays out there. The same 5 products that could have been built in the US and sold to lots of companies abroad, will now have to be bought by the US.

Then with the start of the new fiscal year in October the cut-off dates would have returned to those which had applied during June. However, continued heavy demand in those categories may require the establishment of cut-off dates which are earlier than those which had applied in June. A formal decision determination of the October cut-off dates will not be possible until early September.

But you have to remember one thing here..."Green Card" is just one of the privilege for H1-B or Family Based. This is not your Right get from your Born country to fight for another country GC....

Well said. They have their own self interests in their mind...
Both the AILA and USCIS are playing hide and seek. Who ever shows up first, basically looses. So both are still hiding and we are loosing our sleep. :)

Anyway, I guess people in this forum still have the right to be disappointed by how lawmakers behave. Listen, I have hope that some form of legal imm legislation will pass some day, may be within a year, but I do believe it would take some serious lobbying efforts by powerful people to achieve that. That just seems to be the reality. You can try to ignore reality if you want.
