1 - i have previously applied but was returned due to pd not current , what to file in the form where it say if u have appllied before ? ( i am filing on my own this time )
2 - should the salary be there on employment letter . if so the present day salary or the one with labour approve ?
3 - i have an A# when my file was returned should i use that or leave it blank wherever it is asked also my wife have TIN number is that what i am supposed to write where it ask her to give her SSN

Hunter, this is the first sensible post from you. Now you agree that abusers of this H1 visa system are corporations not the immigrants on their own. So far you were busy bashing immigrants.
Also if US is a free market and capitalist society, why should corporates employ "whoever" is locally available. Its a private money afterall. Shouldent it be upto them to decide how to spend? Also most US corps, have local presence and as for taking a tax break, I hope companies did not promise to create "ALL" jobs in US. Majority of local jobs go to US citizens. They still create thousands of local jobs and pay H1 visa fees part of which goes to train american workforce. If the wages were equal, its more expensive for a company to hire H1 worker.

If you can call it EB2 line, yes he will come before you. On the other hand an EB3 guy calls it �GC� line and says that you come later with a Masters and go before him in the line. It depends on which way you look at it.
I know now you will ask me �will years spent on masters have no value�, EB3 guys will ask you �will years spent working have no value�?. Then you will ask why should they get benefited twice?, 1 in terms of getting into EB2 category and 2 in terms of using old date that was meant for different skill/category. That brings us to the first argument, EB3 guy says if I do not do that then you will get GC first though you got into the GC queue later. The arguments will never end

The total visa's per annum -> 140,000
Considering that there would be more applications during the year from non-retrogressed countries/categories ..it is evident now that there won't be more than 5K such applications. On pessimistic side even if we consider 10K such applications, The visas available for retrogressed EB2 and EB3 should be around 120K this year.
Total pending EB2 is 74,932. So EB2 should be Current for all countries this year.
EB3 should get around 40K visas this year.
Any one disagrees?

To those who did not get it yet, I suggest calling the DOS (202-663-1225) in the US and find out what is happening. They are more likely to give you better information than your lawyer or the consulate staff in India. I wish the consulate staff in India were more courteous.
Extension cases are taking longer than new petitions. Typical processing times 10-15 days. In our case it took 11 working days for verification.
To those who intend to travel to India for a new Visa stamp, call the DOS and verify that your information is in the system. Just tell them that you need to travel and would rather make sure the information is in place and then make travel arrangements. If you just have a week's vacation time be prepared for flight extensions as it takes more than a week to process the extension cases.

I received the card production ordered email today morning, after 1 hr again I received a Decision email. Online status shows as "Decision" , does this mean my 485 is approved?

Any comment? It is a very interesting article, it look like an advice from the WSJ to the repubblican party : do not get dirty with the Immigration, becasue US citizens does not cares. I agree with that. The unemployment rate is very low, and the Agricolture business is based with the immigration labor, the same with trucking, storage and do not talk about resturant and cleaning business.

I am copying into here a great document which I followed to the letter for filing my adjustment of status in May. It is prepared by a major state university who have dozens of people each year going through this process. Thought it might be helpful to some of you.
DOCUMENTATION FOR APPLICATION
BASED ON EMPLOYMENT
The primary applicant and all dependents must each file the following documents. All checks/money orders should be made payable to the �Department of Homeland Security� and stapled to the top left-hand corner of the Form I-485 (Application for Permanent Residence). Place documentation for each application in the order listed below.
1. Form I-485 (Application for Permanent Residence) and fee. Fee is $325 for each person aged 14 and over, $225 for each person under the age of 14. Check box (a) in Part 2 of the form. Form
I-485 Supplement A is not required unless you are illegally in the US.
2. Fingerprint fee ($70) for each applicant aged 14 to 79. USCIS will send notification of time and place for later fingerprinting. Fee may either be included with the check/money order for the Form I-485 or written as a separate check/money order.
3. Two color passport pictures (click here). Staple an envelope with photos to the lower left corner of the Form I-485.
4. Form G-325A (Biographic Information).

It actually comes down to the language. I haven't read the rollover from EB to FB (if at all it happens), but look at the language for EB1. It talks about regular number + any not used by EB5. The language for EB5 is lost when it trickles down.
Does it mean: 1. EB5 can only be used by Eb1 and not rolled down further?
or
2) Does it mean that any of the EB5 unused numbers that are also not required by Eb1 rolls down to EB2.
If it is choice 1, then I suspect we have no case. If however, it is choice 2, then it is clear through the language that spill over Eb1 goes to Eb2 and EB3 at the same time. If not, based on the language of EB1, Eb3 would have just said "unused numbers of EB2", which means it would use Eb1 numbers only if Eb2 did not need them.
Suggestion to go via AILA is a good one, but do we have contact into AILA??

Any lawyer will tell you that you have a case because he wants to make more money. Its like going to Walmart and Walmart telling you that the product does provide value for your family. You take any case to any lawyer, 99.9% lawyers will tell you that you have a case. You go with an idea that you should be the President of the country, they will tell you "Ya I can clearly see why you feel like that and I totally agree, so you may have a case there". My suggestion is, please do not waste your money if some lawyer is saying you that "you have a case". They know that is what you - the potential client, wants to hear.
Our primary point is that the spirit of law has not been upheld.
I bet this is what your lawyer told you. Do you realize how vague this term "spirit of the law" is. But, as long as you are ok to put you money in fire, who cares. Go right ahead, knock yourself, I am right behind you and best of luck, you sure need a lot of it. :p

I see soft LUD on my 485 today, but the status has not changed. I had an interview in Jan 2009 and at the end of interview the IO told me that he could not approve my case as it was not current. So I believe my case is pre-adjudicated?
