My wife is currently in the US and since my PD is current we need to file her I-485. We are trying to self file and would like to know what documents do we need to provide to prove that she successfully fullfilled her 2 year home residency requirement (HRR). She left the US in January 15, 2006 and came back on H4 in February 8, 2008.
The fact that she was granted H4 visa implies that she has fullfilled the 2 year HRR but our attorney said that she needs to prove that my wife did indeed fullfill this requirement.
Has anyone been in this position?
Please advise.

Good thing is after 6 months of EAD ,change the jobs. So the new additional income added to your pot can be used to pay INS if there are any annual renewals till you get the GC.
INS will have atleast 200-300K 485 Applicaitons from Indians and equivalent from chinese, Mexico by July 31'st.
So INS will have a good beer party with Billions of Dollars and fixed royalty income from renewals from the potbellys of Indians, chinese,mexicans. This is a ballgame in no mans land.
Some one in INS did a good math to have good money. With these money, if the new bill et al is passed, can be used to build next gen systems.
Good Luck to everybody including me. I am also in the same race to get GC but i am far distant.

Not an error. Per law you have 10 days after your H1 expiry to wrap up and leave the country. Some CBP officers add that to the I-94

Hi,
I have been searching a lot for the H4-H1 cases and have come across the following responses from my lawyer.
My wife has an H4 from my previous company expiring in July end 2007.
I have a new approved H1 petition from my new employer approved till Aug 2008. The new employer did not apply for my wife's H4 transfer petition.
I am now applying for my wife's H1 and I had queried from the lawyers if I need to do the following :
a) Do we need to apply for my wife's H4 extension now to my current employer.
RESPONSE FROM LAWYER : NO
b) Do we need to apply for the extension for my wife's H4 visa, since it is ending last week of July 2007.
RESPONSE FROM LAWYER : NO
I am not sure if I am getting the correct responses from my company's lawyer.
I think my wife is going to go out of status if my company does not apply for her H4 extension. Is that correct ?
Also, if her H4 is only valid till July end 2007, will the INS issue her an H1 based on this ? Will my wife be forced to leave US from Aug onwards if her H1 petition is pending with the INS?

Hi,
I applied for my first EAD in May 2007 and had FP done in June 2007. I am now applying for my EAD renewal. Will there be another FP for the renewal?
This is really urgent as I am traveling to India in April for a month and I don't want to miss the FP appointment. Please let me know if you have info on this?

There are numerous processings of visas taking place at Ciudad Juarez per day. The consulate processes between 800-1200 immigrant visas each day, 1,000 non-immigrant visas each day, 70-150 waivers each day, and 50-100 various other services for U.S. citizens.
Once the consulate begins its daily operations, applicants should arrive 15 minutes prior to their appointments. There is a parking lot across the street from the consulate, in the Centro Commercial. Before walking to the consulate, it is important that applicants leave their cell phones and any other electronic devices in their cars. After checking that all electronic devices and other prohibited items are left in the car, the applicants will enter the building and go through security. After going through security, they will be issued numbered tickets. All U.S. citizens should be prepared to present their passports (or passport cards if traveling by land) beginning June 1, 2009. check your passport validity and then cross the border if you are near to Mexico and return back on the same day. I did once without any issue. This is quickest and safest way to extend your I94. If you apply for i94 extension it will take another 4 to 5 months.

I've been waiting since 20th of December. Thats when they (NSC) received my documentation reply.. and still no news!!! Have heard that NSC were on vacation (December and January), they just returned ... That's too bad!

The Conrad 30 J1 waiver program has been extended to September 09.

have u seen the legal immigration/ foriegn workers issue address by Bush today. althou he spoke just 1-2 sentences. stating that ' legal immigration system needs to be fixed, so that foriegn workers are in no harm
