Guys, Please do not ridicule saralayar. he has raised a very valid point. We are so involved with the GC issue that we are not able to think beyond that. I do agree with the fact that IV is so preoccupoed with GC crisis that there is no point (or bandwidth) to raise citizenship issue. I have seen so many of my friends who came with me in US 8 years ago and are citizens by now but I am still struggling with GC with no hope in site. Sometime, I think, by the time, I will get GC (if I), they will become sr citizen :) it feels very bad but cant help it.
I agree. We could try for some reduced wait time towards citizenship for people whose GC applications are backlogged or those facing years of retrogression. A good starting point would be to write to Ombudsman with this suggestion. Although this is not an administrative fix it would be good to highlight this furhtur at Ombudsman level.

Really? An active lifestyle, being outdoors, energetic etc. are qualities of an American? A country where 70% of people are supposed to be overweight? Where some say 30% to 40% of schoolchildren are obese? I would agree with your argument for an active lifestyle versus a lazy one. However generalizing to things like getting up early/running/trekking/outdoorsy etc. as typical American traits is pushing it.
If I want to catch up on my sleep on the weekends, why not? I sleep less than 6 hours a day on average during the week. Sleeping less = poor output and also has been linked to poor cardiac health.
You dont have to blindly believe that everything that is American is good.
For example, Americans work the longest hours of any developed country. Does this increase your standard of living. They have the fewest holidays/vacation days.
Maybe doing things separately is your "American way" of fun. Doing things with my family is my way. What's wrong with that. At least we dont have a 50% divorce rate and dont kick our kids out of our homes when they turn 18.
I go out and meet friends by myself. Why does it have to be all boys? Why do I have to drink beer (yucky/stinky stuff by the way). My wife does the same with her friends. Kid is too youg for this.
My point is you are trying to fit into your image of an american. You will never fit in completely. You are hoping your beer buddies are laughing with you and not at you. Be yourself- however Indian or American it may be.

I still believe that the points i mentioned in post are true, from my experience;
but anyone else does'nt have to believe in them at all.
Most discussion on topics of lifestyle are subjective and contextual, thats why hard to explain ones point of view to anyone else.
My simple policy is, i donot care how my kids or beer buddies are behaving; i do make sure i do no harm and enjoy my exercise ( marathons) and beer.....

Most of us in these forums - we talked on phones for a long time and discussed a lot of topics - and we met each other in real at the rally.
I was excited - and I want to share some of my experiences.

I drove from New York with 5 other dedicated IV members ie tnite, tikka, siraviny, ps57002 and a new member Arun
At the Rally I met Niloufer(needhelp) and Vandana, drona and other volunteers at the registration desk and was nice to meet you all.
Then came paskal and gsc999 who stuck a badge on my shirt "chanduv23" and then I met Shivakanth, Vijay Anand and other folks.
After that I met Macaca - lovable guy, some core members like indio0617, ashish, tamsen.
Then I met pappu. As soon as I greeted him he stood up. I thought he was respecting me. I felt honored. But after a while - he was standing up to anyone who greets him. Then I figured out that was his habit - and no respect or whatever :D:D:D
Then met Abhijeet who was carrying his guiter and then jazzbythebay, janilsal and other folks and Jay and Aman and all core team members
Then I met all the Chinese friends in the NY chapter, Jane, Sophia and it was nice knowing them
I did miss out a few names - but overall I loved this experience of meeting you all the folks

Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.
Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.

If we read "USA-PATRIOT Act Series No. 6 - Revised Interpretation of Age-Out Provision" (2002) only, we can assume that CSPA and Patriot Act 45-days can be combined when calculating the child's CSPA age. However, CSPA ALDAC NO. 3 (issued in May 2003) "4. Ref C advised that if an alien benefits from both the 45-day provision of the Patriot Act and the age-out protection in the CSPA, posts should accord the alien whichever benefit is most advantageous to the alien. In most, if not all, cases, that would be the CSPA." indicated only one Act can be applied, even though it's not the "most advantageous" to the child.

Thanks for the update! How about having two cases; a second LC under EB2. In that case can both prevail together (and EB2 and EB3)?

Short answer is "NO".Assuming direct filing in consular Process, in general it takes less time (for most clear cases around 6 months to 9 months) with comparison to AOS. But that pattern was of old times. Consular processing also has to follow Visa Bulletin. Second factor also need to be considered is what ratio is for consular processing. If 10 % of total EB3 + 2 cases might have gone to consular processing then again those US visa offcies will also be overwhelmed. Seeing July-August load ,this time it is very hard to predict consular processing. But just sake for the argument if my prediction for future visa bulletin will become correct then MOST EB3 - 2003/4-consular processing filers will definately get their GC before December 2008. That surely can not be predicted for AOS seeing namecheck etc.

Labor filed in Aug 2002, approved after 6 years in June 2007. Meanwhile, our son aged out in June 2004. Daughter turned 21 today, and her I-485 adjustment application is in the July 2 logjam.
The DREAM Act can be a solution for our son, but some of the versions were made applicable to only illegal immigrants. We have to be careful to read the details whenever the next version makes its headway in the Congress.
I honestly do not hold out much hope for the dream act giving any benefit to legal children, and also doubt it will pass anyway.
Lets see what we can achieve as a group, if we get enough people to agree to help us

Each and every call counts. It all adds up. This is a democracy. The more calls that these offices get, we have a better chance that they would take a balanced view towards these bills.
So, please do NOT get distracted or get into long drawn debates. the admins have done a lot of the groundwork, given a script and are asking people to call. Let us not second guess them or try to play 'smart alec'.

I renewed my passport from houston in september 2009 by mail. I had a great experience. Managed to get the passport within a week without the tatkal scheme.
In your case you probably will have to send a certified copy of your H1b approval notice (with attached new I-94) as well as the old I-94, utility bills etc.
I went to my bank to notarize my documents. There was a problem in that the bank officer said he cannot attest true copies and can only be a witness to an affidavit. So I wrote "I attest this to be a true copy" and signed it myself. The notary then signed it saying, "Signed in my presence". I submitted that and it seems to have done the trick.

The good thing is eliminating the country quota is always lumped with doubling the total quota and/or recapturing previous years waste, so hopefully the affect evens itself out.. Eliminating the coutry qouta by itself is a disaster.

I assume you all checked ur GC wait time - which probably gave u like 10yrs or 18 years from today. Are you expecting vertical spillover to put you on fast track lane?? say getting a GC in 2010? 2011?? 2012???
vertical spillover will only help EB3's that are very close to Visa Bulletin dates.
There are app 200k people waiting, changing how they allocate leftovers is not going to help 200k hungry people. What we need is more food (more Visa's).
