He contacted his senator to get the total number of pending EB apps for India.

If that is correct (same category spill over) EB3 has a very very distant hope of getting some spill over when EB3 ROW becomes C and does not use all numbers. I was of the opinion before that the un-used numbers from EB3 ROW will go to EB1 and then EB2 India.

I have visitor insurance for my mother who is visiting us. Recently she developed some symptoms. The insurance company told us that since the symptoms were due to a condition that originated while she was in India, it is a pre-existing condition.
My advice to you all is to get a physical checkup for your elderly parents in India once in a while. At least you would know if there are any issues which come with old age and you can take an insurance covering those existing conditions.

Got a mails from USCIS that both my case and my spouse's case are approved and card will arrive shortly. However the online status still says 'Pending'.
Is this common and will the online status change in a couple of days?

I have come across some cases where GC aplication I140 was reopened after being approved. So this is no surprise. While I could not find the reasons fully in many cases, why cases were reopened as people tend to hide the true reasons. I think for GC applications the reasons may have included-- suspicion of fraud/complaint against the employer/Ability to pay after seeing more GC applications in the same company and thus reopening past cases/Bona fide intension of the employee to join the company after seeing some irregularity in the immigration applications/too many GC applications or H1B applications from the same company and thus a red flag for an H1B dependent employer.
The best solution in such cases is to first find out the reasons and weakness in your case. Each case is different and one cannot generalize. So each applicant will know their reasons. If the case is reopened, then don't panic. But if you get an RFE, the immediately contact a good lawyer and answer it.

I am little bit worried because IO needs to go to HO and get approval before they can approve an applications due to pending name check over 180 days. there was law suite and Judge has forced USCIS issue green card if name check has been pending over 180 days but, there has been new memo from USCIS field director and IO has to write to HO and get approval in these cases.. I am not sure whether an IO will be willing to go head office for an applicant.

In this day and age the news travel fast and if we expose wrong people it will help everybody. My friend told me that his brother in law wanted to come to US to earn his flying licence. He wanted to go to this one school in California. My friend left three messages with the school last year buy luckily no one returned his call so his brother in law joined a school in GA. I am speaking in my personal capacity here. While I am all for freedom of expression and assembly, I don't think that rallies will in any way help our cause. We have to talk to people and participate in various forums to make them aware of our cause. Standing and protesting is not going to help us, because our voice will still be lost in the din...we need to speak where it matters and be heard where it matters...

CNN will always ignore us thanks to our friend there, but has New York Times ever reported our plight? Has Jim Leherer ever talked about us? The main stream media does not even know us!
We need to do something that catches the attention of the media; just getting more members and more funds may not be enough. We need to write letters to editors of major newspapers like NYTIMES and WASH POST.

Outsourcing companies didn't write it.

Why should an H1B pack his bag in zero days when he loses his job ? ( He doesn't even get time to sell his house, take care of his kid's education etc)
Why is an H1B employee asked to pay for social security and medicare when government knows that he cannot take advantage of these benefits ?

Is this situation only in Chennai consulate or in all consulates in general? I have not heard of any trouble at other consulates. I am taking an appointment this week and will choose a consulate that may work faster (Delhi or Cal).

Not a bit. If you want I can give you a plenty... L1 is for intercompany transfer. But So far I have seen companies put people only at the client place and their salary is starting at 32K and they are put up at extended staty, asked to share the cab or car. So let me know if you want and I can directly let you talk to those guys.

So our common goal is to fix the broken system, remove the employer's undue advantage over the employee. No matter if they are MNC or desi consulting companies. Why the employee is tied to the employer when there is the need/demand for the skill set. Thats the only thing which is driving down the wages.
I fully agree with this. L1's being placed at Client's place is ILLEGAL. I have several proof's of this. TCS, Infy, CTS and LT do FAVOR their employees with a gift of filing in EB1 because these guys WOULD not complain to any one what they are paid and their benefits.

we had Infopass appt. IO said your case is pre-adjudicated and under Review. we ask how long will it take to review? He said - doesn't know. can we open SR? He suggested not good to open SR. Reason is they will give same reply - case is under review give us 3 to 6 months. USCIS always tell us to "Not to open SR for Under Review case". Let the petitioner to send latter to request the status directly by sending latter to,
