I am a person from SOuth India and i have been in US for the last four years and i came to US on F-1 and then changed to H-1B.

Am i eligible to apply at Delhi consulate for the H-1B stamping. This is my first H-1B stamping.

I am on H1B and my wife is in H4 here. She is a nurse and can apply for the AOS before Aug 17 .But she does not have all certificate that makes her AOS approved at this time. We hope that we can obtain the certificate (Visa Screen certificate) by the time the RFE comes. But it is a 50-50 chance only. So what could be the best option for us and consequences of each.
My case (h1B)
1. I also apply for AOS with her so that I can get aGC along with her but do not use the EAD .
2. I apply for the AOS later but before her AOS approved.
My wife case (h4)
1. Apply for the AOS but do not use EAD
2. Apply AOS and use EAD.
Also do you know around when the USCIS issues RFE once the application is recieved?
I really appreciate your advice in this.

Hi,
My H1B 6 years will be finished in February. My I140/485 were filed in August and I will be laid off on December 31. What options do I have now?

- My employer had filed my immigration papers at my current work location. They are willing to relocate me to different location but are not sure on the impact of change in address. Can I relocate with my current 140/485 filed for current address?

- Can my H1 be extended based on approved labor? I can then move to new location with same employer on renewed H1B and start the entire process again?

Anybody filed Un Signed Labor Substitution?

Since the cut off date was Jul 17th my attorney filed un signed Labor substitution with I-140.

Any experince any body has, I request you to share that here.

Chance of denial or rejection is very high if the Labor substitue application is not signed by the applicant.

Hello All,
I need ur advice.

My H1 expires this sept 19th 2010. I don't have the present H1 stamped.
Also, I have the new extended H1 which is valid from Sept 19th 2010.
Now, I'm planning to travel to India and go for stamping.
1. If I go for stamping before sept19th, on which H1 will i get the visa stamped,present H1 or the new extended H1?
2. Is it safe to go before sept19th or after sept 19th? I prefer the stamping on H1 extension.

I'm flexible with my travel.
I'm waiting to book my appointement based on the advice given.
Appreciate ur inputs!!

Most of the members here think. GC are long pending only because of beneficiary or USCIS only.

This news is also making me to think about the reality of the issues in finding the good company for GC processing.

Hi,

I am planning to travel to Indian in coming months. However, I have a stright outright dismissed CMIT case back in 2007. I got the non convincted case expunged. I got FBI finger print results and they say no records were found. I got BCI from state which states no records were found. Last time , I travelled abroad was in 2006. I have a valid AP.

Do you see any risk of re entrying US on AP?.

Your help is much appreciated as I have to have to be there in India.

Animal portraits are my "thing", so I don't mean to be overcritical... Try to get the animal's face in the light. The rooster's a good subject, and you got down to rooster height, which is really good, and you got him when crowing - a great behavior. Unfortunately, the face is in shadow, and that means you don't get the "catchlight" sparkle in the eye. Also, you often don't get the eye quite in focus, since autofocus works on contrast. A lot of faults in a protrait can be overlooked if the eye is sharp. In this case, you're focused on the neck feathers, not quite on the eye, so if you can reshoot it, try for getting light in the eye, and I think you'll like the results even more. when filling the education details in DS 157 - I gave the STD code wrong,for one of my educational institutions

You can go online and change; In case, you are unable to do it - take a print out of filled application and correct it by hand, dont worry about this.

When we file 485 AOS along with EAD & APL, these are three seperate forms, so we get three seperate receipt numbers?
