If more than 180 days have passed since your I-140 was cleared then you can use AC21 and use your EAD to transfer your GC process to Company C if the job responsibilites are the same as in your job profile that you submitted for Company D . Your GC process will continue as usual in that case. No need to worry.

Hi,
I filed my 485 on July 5, 2007 at NSC and got my receipt number yesterday. I sent my wifes 485/765/131 on July 24, 2007 to NSC. She is on H4 currently. TOday i got my wifes receipt numbers for all 3. But to my surprise the receipt numbers were given by TSC instead of NSC.
FYI my 140 is pending with NSC.
I am just wondering if this will be a problem? Any one had been through similar situation?

Here is the contextual description of my scenario:
I worked in a motel (while i was on F1) during the year 2007 and that salary was reflected on my W2. I maintained a clean work status after the initial transgression. I changed to H1B in the year 2008. My GC process was initiated and my application cleared the PERM and I-140 stages successfully.
My question is, will i face any hurdles during the I-485 stage because of the mistake that i committed while i was on F1 ((worked in a motel illegally)? If yes, how serious/low profile could the implications be?
Your advise is much appreciated.

I was supposed to get my degree in 2000(Electronic Engineering) however due to backlogs and since I started job before degree completion I completed my degree in 2005.
Is that a real big problem?
Although I have double bachelors one in Electrical Engineering and other is science but my work evaluation is based on my bachelor of engineering degree.

Hello All,

1) Recently got my L1 extension approval through company A which is valid through Aug, 2010.
2) I also have a Consular-H1B petition papers from same company A which is valid till Aug,
2011. But i don't have H1B visa stamp in my passport.
*My question is:
Is it possible to do H1B petition transfer from Company A to Company B without COS from L1 to H1?
OR
Should I first apply COS from L1->H1 through company A and then apply for H1B transfer from Company A to company B.
(and I believe for COS to happen i need to be still employed with company A.)
I am not planning to go India now but wanted to apply H1 transfer and work for the new company B in case of my layoff from present company A

Technically yes. But USCIS looks at cases under a microscope when they see multiple applications from a same applicant. And if the the sponsor is a small firm, you can expect some careful screening. Increasingly USCIS is making efforts to ensure GC system is not abused by people. A lot of companies had in the filed for GC for several employees and GC applications for latter and sometimes former applicants were denied when it was found that the employer cannot show enough funds to support them. Take the risk only when you are sure. Lawyers will be happy to file multiple applications because they will get double their fees. BTW each lawyer generally makes you sign a contract beofre taking a case where the lawyer says that he cannot guarantee GC and if it is denied, lawyer takes no responsibility.

That is correct. If your employer is enrolled in E-verify then he needs to updated your information in that system otherwise just keep the form for record.

Here's an example of my first outing with my new lens, shooting birds in a nature preserve bird feeder area. I used a monopod on a cloudy day. I didn't realize how quick those little buggers can be. I shot manual and found the autofocus to be irritating at times. Any feedback on doing this kind of shooting would be appreciated.

I want to extend the stay for my Parents for few months. They are on visitors visa. I am aware that I need to file form I - 539 for this purpose. I am not sure what reason should I specify for extention?
If some one had done extention for visitors visa in past please, I would appereciate your help on this.

Ideally, I wouldnt recommend, having them overstay. This might have issues in the future, if they plan to visit again.
If they have a 5 or 10 year multiple entry visas, they can go back home and come again in another 6 months or so.
If some one had done extention for visitors visa in past please, I would appereciate your help on this.

It is possible to "interfile" in this situation, (See AFM Sec. 23.2(l) Transferring an Adjustment of Status Application from One Underlying Eligibility Basis to Another).
However, I do not think you can successfully interfile until your wife's 2010 PD is current. ( See AFM Sec. 23.2(l)(2)(L) The Priority Date must Be Current for the Basis to Which the Applicant Wishes to Convert).

Hi,
We had been to Canada in Sep, 2003 for our Canadian residency stamping. While on our way back to San Francisco, US immigration did not stamp our passports or take back our I-94's. Prior to this trip we had been to India in March, 2003.
Now I am confused as to what should be our last date/port of entry to US? I-94's/passport stamp still indicates our March, 2003 trip and Our Canadian PR stamp does indicate date PR was stamped in Canada. But there's not other stamp/proof on passport for our entry to San Francisco.
Any pointers/suggestions?

Gurus, please help. Can anybody throw some light on why my LUD has changed on I-485. Could it be because of name clearance.
Name check cleared would not result in a lud. But if you get more luds in the next couple of days, which probebly means they are processing your case, you can say your name check is cleared, because they only start process your case after name check is cleared.
Is you PD current? If not, your case cann't be approved no matter how many luds.

A LCA has to be filed prior to your working at a new location. Make sure to file it ASAP. It's a simple procedure to follow.
