My company filed for PERM in September4,2007.Audited in October.reply was filed first week of November.Still no word on the PERM processing.My H1B visa expires June 30,2008.I have spent app. 7 weeks out of USA in the last six years.if I take a 3 week vacation out of the country can I extend my h1b visa to say September 15,2008(it will be 10 weeks total).And then be eligible for the 365 day rule for H1b extension.please reply.don't see too many options right now.

I just learned about this initiative today and immediately joined. I think it is a great way to pursue our goals and this iniative for each member to invite atleast one or more others to join the community is a step in the right direction. Keep up the good work Neelu! It's my turn to bring awareness of this effort to some of my other friends who are in the same quagmire.

Thanks for the response. I believe I should check with the school. If the school accepts just the proof of having applied for COS, then I should be fine. I dont understand if they accept F1 application proof, then why not for H4 ? Anyways thanks a lot.

After failing to get a definite answer on the exact time taken by the process of changing status to H4 while in the US, I have decided to take a trip to India to get this stamped instead. I was told that change of status to H4 needs to be approved before starting school, simply showing proof of having applied for COS is insufficient. But if you apply for change of status to F1,then approval is not required before starting school. However I would suggest you confirm this from your lawyer/school.

You should have only one I485 application pending at a given time. If you file a second application your lawyer would advise you to withdraw the first one.
Personally, I prefer an AOS to consular processing since I am in a stable job and of course my spouse would need EAD.
So the answer to your question is that you do what is best given your situation.
Also, since dependants are currently counted in the 140,000 available EB visa, it does not matter if you use one or both of your approved 140.

I have some questions with regards to my wife�s immigration status. She was previously on H-4 visa (valid till 2009) when I was with employer A. She then applied for an H-1 which started from October, 2007. She started working on a project from November. The project lasted for couple of months. During that time, I transferred my H1 to employer B. Since January, her company has no projects for her and she is not working. But they had been asking her to sign leave of absence and providing partial pay stubs (one week in a month) since then. Now she wants to transfer back to H-4 status and we are planning to file for a change of status from H-1 to H-4. My questions are:
1) Are pay stubs of current H-1 employment required while filing for change of status to H-4?
If yes, will it be OK if she just provide a partial month pay stub for last two months and rest of the days, we can show it as absence of leave due to some reasons? This is to avoid large amount of taxes which we have to pay in order to get the pay stubs. The employer is ready to provide other papers required to prove current employment with them. (Like offer letter and other stuff)
2) Can she go back to India without change of status and stamp her previous H-4 and come back to US on H-4? The problem I feel with this situation is that her H-4 was approved when I was working with employer A but currently I am working for employer B. So does that mean that she has to apply for a completely new H-4?
3) Can we go to any other country like Canada, Mexico, and Bahamas and get a new H-4 stamped for her? Or it has to be done from India? I will also get my H-1 stamped the same time.
4) What are the documents that will be required to file for COS using form I-539 and how long it usually takes to get approved?
5) Can she travel to India while her COS is still under process?

I have pursuaded people ("friends") to join and contribute but all they say is I will .. never seen one do it .. ashamed of 'em ...I dont really understand why people are so hesitant to contribute. We need a group effort my 50 dollars a month will achieve nothing unless lot of people do the same.

Letting all this Indian Consulting Firms taking ALMOST all the H-1B visas is very unfair for everyone of us that we are working hard to get a job in the US. In my opinion, they are trying to monopolize all the H-1B so no other company can be able to hire foreign professionals by themself. In this way their only way to get professionals is thru them.
It is very UNFAIR that this consulting companies takes a large number, getting almost everything, of H-1B visas without having a real job for them. This companies will offer this H-1Bs to other companies, making it a big business. Additionally, I believe that indians also pays to this consulting companies for the H-1B.
Even if the congress raise the cap without making changes in the system, it will never be enough. It will just increase the profit of this consulting companies. I only hope that the changes going to be introduced to fix the system will not screw us and complicate more the immigration process. But realistics and effectives changes are needed.
Good luck for everyone who are in the H-1B lottery and really need it.

Wouldn’t it make more useful for the “best and the brightest” to provide solutions to many companies at the same time by working for consulting companies? These companies have filed for large number of H1s that too would have finished the H1 quota. If it is ok for an H1 employee to work for a shoe making company, then why is it “UNFAIR” for H1 employee to work for a consulting company?
Bottom line is:
1.) There is green card backlog for 6-10 yr. Any company would love to get an insurance policy that an employee will work for them for that long period. So one reason for this quest for H1 is due to delays in green card processing. If someone gets their greencard in 1-2 yrs., H1 visa approval will not get the employers any insurance policy for long term employee. And the demand for H1 due to this factor would subside.
2.) More importantly, even if demand for H1 would subside due to green card processing in 1-2 yr, the fact that unemployment rate is very low will still exist. Unemployment rate is making it hard for companies to find the right people at the right time at the right place. So companies are looking for ways to recruit the necessary talent, wherever that talent is available. IEEE wants all foreign engineers out of the country so that their membership base of engineers here, who do not want to learn new technology, could get the taste of late 90s. So for you to first attack a set of consulting companies and then cheer around the bill hoping that “the changes going to be introduced to fix the system will not screw us and complicate more the immigration process.” is exactly how it is going to play out. Infact, anti-immigrants will come to this site and cut-paste comments like yours into their report to strengthen their argument when they would go out to lobby in favor of this bill. 1) B4 IV, how many organizations/Individuals have voiced their plights? If you keep suffering silently, even ur next door neighbour wont know if ur alive or dead.
2) We are not american citizens or even permanent residents. Why will the law and the lawmakers care for us automatically? Forget about vote-banks for a minute. Think about why they will care at all, especially when no one was voicing an increase in Green Cards? Big corps have voiced an increse in H1B's and they got it from time to time.

Since its a PD portability case, probably no PD is written on the receipt. It might be to be determined.
I'm not sure if you can file your 485 as well - dont see a reason why not. But one thing you can do to have better sleep at night :-), is to upgrade your 140 to Premium processing. If you get it done tomorrow, you will have an answer and portability of PD by end of this month. Then you know for sure where you stand.
