In its Response to the Ombudsman’s 2006 Annual Report recommendation (AR 2006 – 01), USCIS agreed in principle to provide a breakdown of all incomplete cases by the number of months pending and application type, and stated (at p. 7):
Given the constraints of existing legacy case management systems, USCIS would today need to perform a cumbersome, labor intensive, recurring manual audit of all pending files in order to compile the suggested data. Such audits would be cost prohibitive. (page 13)
USCIS has opted not to use its limited financial resources to extract data from current systems and prefers to spend it on prospective systems that are years in the planning. For example, USCIS has not made corrections to the CLAIMS 3 system to capture data on applicants’ priority date information, country of nationality, and the preference category under which the application is filed that USCIS must review before the application is accepted for green card processing. (page 13)
Failing to correct the system annually results in hundreds, if not thousands, of wasted hours by all levels of USCIS leadership in trying to account for an often asked question by Congress, the Ombudsman, stakeholders, and others: “Exactly how many employment-based green card applications does the agency have pending?” USCIS still cannot answer that question today with certainty. I spoke to a IO from Nebraska center ,they said my data is not in the system.She said no memo has been issued how to process the July 2nd cases,but they will process all the other cases according to VB 107.when i asked more she said she cannot give me any more information i asked her should i resubmit , she did not comment on that i was totally surprised when i asked her when the cheque will be cashed she said october, I again asked her and told her it is not for H1 b it is for I 485 again she said october.Did you any of you guys call the USCIS ??

Just talked to my lawyer..he said even if we win the case...eligibility is based on the court order...court order may allow every one or only limited people who are in the class action...and in murthy.com they clearly mentioned that, USCIS MAY look at the apllications very closely who are in the class action....who wants that..

Thought I'd offer an alternate view on the AC21 letters. I switched jobs after my I-485 had been pending 180 days, and my attorneys advised me to NOT send in an AC21 letter. They said, "Chances are, you will not get an RFE, and if you do, you can send in the AC21 letter at that time. If you do send in an AC21 letter, you will definitely get an RFE". These attorneys had always given me excellent advice in the past, so I have not submitted an AC21 letter.

I am also close to situation 3.a but I changed my GC sponsered employer and working for other good and stable company using AC21.
I would like to start a company and do a side business.
What you recommend - registering it on my is good idea or on spouse's name?
If I register it on my name and generate a profit - is it going to impact my 485 as I already invokded AC21? (again I will be working in simialr job as a FT)
Any sugessions would be great help.

If you are on 3a, you have neither used AC21 nor have you left your full time job (FT job that aligns with your LC). On EAD, you can do any number of jobs (ex: you can even work 2 part time jobs totally unrelated to your LC requirements ofcourse as long as you continue to be with your GC employer). Using this rationale, you should be fine starting a business and making profit in the part time.
In fact even those who were in 3 b were able to get their GC after an interview (Search for posts by the user "unitednations"). But, it's risky and best avoided.
Personally, I want to get into 3 a, but my 140 is still pending. I plan to approach my company to switch me to EAD as soon as my 140 gets approved.

There are a few points to be made here.
First, there are many procedural votes and we are not always privy to the happenings behind the scenes. This was alluded to in other places.
Secondly, although it was defeated, there was a healthy simple majority and this augurs well for any reconciliation process.
Finally, any impetus for immigration provisions are likely to emerge form the house side, who have been seeing our plight up close. There are likley to be some behind the scenes arrangements made and the final agreement may look slightly different. For example getting Sen. Durbin's support by getting in the H1b restrictions will get the support of some more Democratic members, they could then proceed with the favourable provisions. All said however, it is likley they wil do this as a rider to some bill rather than in the glare of the public as a stand alone bill.
I just hope the staunch CIR folks, become a little more pragmatic and stop being a hindrance, and stop holding legal immigrants hostage to their issues. They after all call themselves pro-immigrant, right? Ironically convincing them of that seems to be our most difficult hurdle.

Called USCIS on friday and asked them to expedite since i can lose by job. current ead expires on sept 5 th and filed renewal on june 24th. I see so many cases getting approved with much later dates.
Any sugestions on what steps to follow?

From everything I've read before, it is safe to stay with the sponsoring employer for at least 6 mos.
There have to be extenuating circumstances to leave earlier than that, and be prepared to elaborate during the citizenship interview.

Anyways, we are in process of creating an eye opener fact sheet that we will be distributed with the promotional fliers. The objective of the fact sheet is create a sense of urgency and draw people's interest to DC rally.
I am looking for ideas as to what to put in the fact sheet, while I am still waiting to hear on my other post.

as far as I know, you paying for H1b is not correct and is illegal and they will be accountable for this. Secondly, I heard the contract dont stand in court, especially when they are rude.
I think you have an option to report this employer to DOL/USCIS, for charging you the H1b expense. Companies should sponser H1b only when they genuinely need and can pay for the expense!
I am not a lawyer, so I recommend you consult one. Also feel free to communicate this issue to your employer and I guess you will be on your own!

Less than a month ago, I got mine renewed in IL(it expires in a year). Why take a chance with all the new policies?

Yes, I do agree with you but he asked a specific question related to travelling, and this case expungementg will help and he need not to declare at the POE about his case but as you said he will have the side effects of this case in various other stages till he is admitted as PR.

Even when he gets his criminal record expunged, for all immigration matters, he needs to provide information about his conviction and an explanation.
