    This is just a misuse of H1. They should bring up a new law stating the H1 will automatically get cancelled if the beneficiary does not get employed in three months. With this, the real demand for H1 could be estimated easily.

    The speed in which h1 FOR MS in USA shows that there is not that much demand to H1s. Only around 7500 was filled. The H1 Cap 65000 was reached for because Indian companies were rushing to make it before H1 cap is reached. One has to analyse how much is going to be used really. They will use need basis and won't cancel if not used. So increasing to 110k will be enough to meet the real demand but then also Cap will be reached in another 2 months because consulting companies process h1 first and find the job for them later. But Real demand can be analysed in other way. Because of Rushing thro H1s lot of companies which are having Real job demand(Companies like Intel Microsoft) could not hire. H1s for US MS degree holders solved the issue Partialy. May be if the increase that quota to 40k then demand will be enough.

    Finally after the third "card production" email (June 23rd, July 15th, July 29th) i got the card today valid for one year. I efiled on April 27th. My PD is April 2006 EB2. So i guess thats why got only for one year.

    A few years ago Ajay Sehgal (not his real name), a young Indian high tech worker based in Connecticut, received a letter from the Social Security Administration.

    The letter stated that through the six years that Sehgal lived and worked in the United States -- first on an H-1B visa and later while his greencard application was pending -- he had contributed approximately $50,000 in social security taxes.

    Since he was unsure of whether his greencard petition would be approved, Sehgal thought he could cash in the $50,000 and return to India. So he approached his local social security office.

    "It is my money after all," Sehgal said recently. "If they will not allow me to live in this country, if I cannot retire in this country, then they should allow me to take my money and return to India. Right?"

    Wrong, said the local social security office. He was told that foreign employees (including those on H-1B visas) who may have worked in the America for a few years could claim social security benefits upon retirement, but this depends on the country of their origin.

    In fact, Sehgal later learned, as an Indian citizen on a temporary visa such as H-1B, he could not receive any social security retirement benefits -- even though he had legally paid his social security taxes.

    "An Indian national on an H-1B visa is here for a period of six years," said Herb Loring, a social insurance program specialist with the SSA office in New York City. "And this person would get nothing. That is the law."

    "But if this person came back and worked for four more years, under whatever status, and fulfilled the '40-quarters' exception rule, then this person could receive social security retirement benefits," Loring added. "Basically they cannot collect their money if they are an Indian national, unless they meet the exception."

    The '40-quarter' exception rule, Loring explained, means that this person should have worked in the United States for at least 10 years. He added that this exception rule applies to citizens of over 30 countries who may have been employed in America for part of their career. The list of countries includes India, China, Afghanistan, Thailand, Kenya, Tunisia and Bangladesh, he said.

    Loring added that workers from several Western European countries and Canada can claim social security benefits even if they worked in the United States for less than 10 years. The reason he said is the United States has treaties of reciprocity with these countries.

    "The reciprocity rule in the treaties means that if a US citizen went to this other country and worked there for a few years under that country's retirement system, then the US citizen could also collect retirement benefits from that country," Loring said.

    In addition, the United States also has 'totalization agreements' with some countries, such as the United Kingdom, under which US nationals can receive retirement benefits based on their combined work history at home and in the other country.

    But America has not signed any such treaty with India, Loring said. He suggested that the reason could be that India does not have a national retirement system similar to the United States and many other Western nations.

    "I cannot comment on the question of fairness or unfairness," Loring said. "This is law in the United States."

    But for workers like Ajay Sehgal the laws reek of discrimination, especially since the largest contingent of H-1B visa workers in the United States are from India and China.

    "I call this daylight robbery," Sehgal fumed. "This rule has to be changed."

    "Giving us a greencard or not giving us a greencard is your right. I fully appreciate it. But why do you rob us of our social security? If you are a fair country, either give us the greencard or refund the social security."

    Waiting is all we have been doing for so many years. I have been living separately from my wife for last 3 years. When I reached out to Pappu on IV, he refused to do anything for me. I am ready to come forward and talk to media but nobody is here to listen.

    I am seriously considering some media awakening event these days, it might be suicide or whatever it takes but this DOS stupidity has to stop. Its affecting so many people's life. I agree GC is not a right that we can demand from US government but they can't treat us like this after investing so many productive years for this Economy.

    buddy...your quote kinda worries me. I can understand what you have gone through but always remember there are good things to life beyond worrying about this GC mess, following visa bulletins, and subsequent frustration/high bp/heart attack.

    I do what I can to educate the people around me about this legal immigration limbo and whatever within my control. I suggest you chill and use your energy positively to benefit yourself.

    Spring is here and I am going fishing this weekend, wanna come along?

    Re-capture unused visas over the previous years

    Now that we have the pending data from USCIS, we could create an persuasive and execellent presentation to show USCIS how EB3 I will never move even if more visas are re-captured, unless and until the spill over is used for EB3 I also

    I guess DOS/DHS won't provide all documentation, just like recent firing of US attorney.

    They didnt provide docs for the US attorney firings because Bush cited "Executive privilege" ... there is no such "privilege" in this case .... Bush hopefully had nothing to do with the DOS/USCIS screwup :)

    Great Job, Kudos to you for making such an effort.

    Similar to this, we need as many efforts as we can have.
    To further continue this effort, I would suggest writing letters to your local congress rep & Senator, particularly those who have been waiting for over 5 years.
    More effective approach will be to contact local media.
    Since we have a unique situation, I would recommend start a request to separate legal employment based migrants from other categories.
    BOTTOM LINE: We can not wait for CIR, this is NOT about comprehensive immigration reform, this is a requirement from current employment based immigration system.

    I took a poll on this website like a year ago.

    The results were very similar to the trackkit poll.

    In summary, about

    50% are with PDs of Year 2000 - 2004 and 50% 2005 - 2007.

    I was surprised to find EB3 PDs in 2000 and 2001 but there were few.

    So far this poll is also showing similar results.

    After a long wait i have my priority date became current. But my employer is saying to wait for some more time before he can file for I485.What can i do in this scenario? He is saying the dates are going to remian the same for next couple of months.Please suggest.

    Please note that even tho the dates have moved, we are not out of the woods. There is a definate possibililty that the dates could regress in October. If you choose consular processing and your category/country retrogresses then it will have implications. Talk to your lawyer before taking any decision.
    If you are lucky then its straightforward, for some its a nightmare, namecheck can take some time in the meantime your category can regress.

    I'm trying to make decision to pick consular or Adj. status.
    Please, can somebody tell me the flow on Adj. status here.
    1-File 485.
    2. Finger Print notice (you said around 30 days)
    3.?? (medical??)
    4.?? (FBI??)
    5.??

    and total approximate time for same center for all family.

    I really apreciate if you can also write your experience to compare Consular and Adj. status.

    It was great meeting and working with everyone especiallyJay,Aman,Himanshu,Vandana,Prateek,Nilli, Vandana,Mark,Tamsen,Puneet (yes- I am being nice to you inspite of the lawyer jokes u crack at my expense!!!),Anil,Sanjeev,Rajesh,Macacaa(yes I was a bit too hard on you:)but it was all in good spirit) and ofcourse my friend Meenal. I just want to thank a few volunteers who worked on lobby day meetings with me but could not attend the lobby day or the rally day-Fora,Vasu and Payal. We are all so glad the lobby day meetings and the Rally went well. It really shows what we can do when we all get together. Kudos to IV and its members!

    Both Addresses will be printed on the passport. One for current address in USA and other for Indian Permanent address.

    Application form is asking for address to be printed and other address. I am planning to keep my India address (my place) on my passport. I use my passport as a address proof in Inida. It means i need to fill it in address to be printed coulum.
    What is the other address. Are they going to print this in passport as well. If they are going to print this in passport, can i give my India address here as well? Is it mandatory to give one US address (other address)? Please help me. I am trying to renew the passport and would like to keep my existing India address.
