Longest I have seen a 485 denial go without getting reopened is 5 months.
If a person doesn't have h-1b then six months is a magic number. If person overstys six months and uscis ultimately denies it again then person is in terrible situation (3 year bar).

Zazona report goes wrong in two directions.

My I-140 got approved even though my company also did not file 2006 Tax return. My company is a small(less than 30 employee) loss making company. Our company secretary just gave a letter that company has not filed tax return for 2006 and has asked for extension, attached request for extension. If you are meeting any one of the three criteria of the yates memo, there are very high chances of I-140 getting appoved. Search for yates memo and you will get more details. Is your current wages more than prevailing wages? If yes, then you will be fine. Your lawyer has do a very good analysis of companies ability to pay prevailing wages. So work with your lawyer and you will be fine.

In meantime I asked my lawyer what my employer would need to get for me (my employer has been a major pain and slow beyond words...took years to get PERm going...i'm seriously just done/depressed with so much). My lawyer said they would need to provide 2006 tax docs and sign bunch of papers etc.
Checked with employer...it's an average work place...must have 100 employees i think....and i'm told by HR (this woman in charge seriously has some stuff against me...i don't know) that they don't have 2006 returns, just 2005...come on a legal place like them has to have filed 2006 return.... but this is what i'm told..
I guess what's the point...without those docs, which i assume are initial evidence, i have no hope....
me...really sad....

In my opinion USCIS will not give inaccurate information, in writing, to a Senator. The letter clearly mentions 'Application Pending for India'...
USCIS might not have intentionally given any incorrect information. Perhaps to them what they sent means "EB applications pending for India". Key part is "for India", which quite likely does not mean chargeable to India.
I doubt if they can easily track out applications chargeable to India that easily (even if $5K is sent to them). Whatever is entered in the system when USCIS receives paper applications (e.g. name, address, date received, category, date I-140 approved, etc.) can only be used as a criteria for queries. Birth country perhaps is only on paper application, and is verified for approrpriate chargeability at adjudication time. Systems are not designed for handling cases where country of chargeability is, as is the case for us, the final stopper.

Reading the thread it seems like there are a few steps being dicussed here:
1. Hunger Strike
2. Go the court way for failure of visa spillovers
3. Letters, Faxes etc etc.
4.. I am missing something that someone can add.
I am wondering if hunger strike will work. First of all hunger strike is useless unless its heavily publicized. For publicity we will need to be at Washington (maybe not )and strike for atleast a week before we get any publicity. That means risking physical health as well as professional life. Moreover we will need a large number of people to make news. It has to be a well publicized and a successful strike. It will surely have more impact than the rally.
I suggest writing one letter everyday to white house and to USCIS. If thousands of us write two letters a day everyday to President and USCIS it wont cost us much and it will be a continuous effort till we come out with a more substantial effort like a rally or hunger strike.
Feel free to blast my ideas and suggest others.
Lets be all a part of the core team and not get an opportunity to say that the core team is not doing enough

You're right. No offence but no authority seems to be listening to IV suggestions. I agree that people at IV are doing great job, but the problem is nobody is listening. They just don't care. And this think will go on & on. I remember s'body suggesting hunger strike and at that point of time I thought that won't work. But now it seems we have to go extreme and do hunger strike and stuff to pressurize this crappy system.
EB3 people don't think I am being selfish here. The truth is we have to work unitely and pressurize for visa recapture. That will be beneficial for e'body.

Yesterday, my sister in law entered USA from Newark Airport and she witnessed three people holding HIB visas get cancelled at the immigration point, one had EAD.
All we Desi's want is a free ride, same old mentality, don't want to put in any diligence in this matter, but very quick on pointing short comings on others. Blame game!
Point is, we all need to do something radical, sending flowers again and holding a hunger strike, otherwise, keep coming to IV and keep getting disappointed.

Not because they don't have a job but due to better prospects back home (booming economy et al). They came here since America showed promise.. they left because the way they were treated was not what they expected. Bottomline America failed to holdback those brainy folks. They may have said yes to you. They probably wouldn't have bothered. So coming back to our conclusion. Wrong question.. wrong addressee..:p
