Hi,
My parents got their second Re-entry Permit approved (applied through Application I-131) in first week of Jan 2008. This rentry permit is valid for 2 years (i.e. till Jan 2010). They had applied for the second Re-entry Permit on 16th Feb 2007. And after applying it they left 19th Feb 2007.
They are planning to return to US in Jan 2010 before the Re-entry Permit expiration. I read on this and other forums that with Re-entry Permit a US resident can live outside for more than 1 year and less than 2 years.
In my parent's case, when they will return back to US in Jan 2010, they will already have spend 3 years outside US.
I was concerned that the 2 year stay limit will be counted from the day my parents left US or the day when the Re-entry Permit got approved?
Secondly, Is there any limit on number of times a Re-Entry Permit can be applied?

Recently, one of my co-worker who was on L1A, requested an extension of his Visa. His employer filed for an L1B instead and did not inform him until after filing it. Now USCIS has sent an RFE. Does anyone know if this can be grounds for rejection of his Visa? Is the employer legally correct in filing a changed Visa category at will without informing the holder? His wife is unable to obtain a driver's license since the Visa approval is pending. Does anyone know if this can be addressed? If so, how?

Here is my case
I came to US in Aug 2005 on F1 and My I-94 was till Duration of study.
I graduated and my OPT was from April 27th 2008 till April 26th 2009
MY company applied for my H1 on April 1st 2009 and got it approved starting Oct 1st 2009 ...but i got I 797 B ( which does not have an I-94 and is H1 approval without change of status) instead of I 797A.
I 797 B is H1 approval without change of status, My employer applied for amendment on May 2009, but again i got I 797 B instead of corrected I 797 A with a start date of october 1st. Same thing happened 3 times and now i got I 797 B again and my company says that they are going to file for the change of status again but its already November and i dont know what to do.Wanted to know if somebody has gone through the same situations and If i go to India(Chennai) for stamping what would be the problem.
what should i answer if visa officer ask's me about what have you done from April 28th 2009 tilll October 2009 and as you were not in OPT or in H1b why did you stay in US...

Hi,
Regarding A# on I 140, if you've missed that in your 485 application, it's no big deal as long as you've sent a copy of your I-140 approval notice that has the A# mentioned in it.

You must be actually in H-1B status in order to use the H-1B portability provisions. This is what allows you to start with Company B once their H-1B petition is filed, rather than wait until the petition is approved. To use this, you need to get into H-1B status for Company A 9either through a COS petition or by entering the US in H-1B status. I don't recommend that latter option if you know that you will be changing employers as soon as you enter the US.
Alternatively, you could change from Co. A L-1 to Co. B H-1B, but you cannot start working for Co. B till the COS is approved.

I am getting ready to n-470 to preserve residency. My company is sending me to UAE for one week period which will leads to other long back and forth trips there. I need to file n-470 to preserve residency for naturalization. I have already lived here for more than one year as a permanent resident. My questions are:
1. Where do I find a sample communication letter as a support document?
2. What do I write in it?

I have been arrested on Domestic Violence call by my wife ( of cource false allegations) about month back. Police investigation did not find any evidences and never sent file to DA for filing hence DA never filed charges.
Now USCIS requesting following
1) Please submit an arrest record and final court dispositions for each of your arrests. Court dispositions must be in the original and bear the stamp and/r seal of the appropriate court or clerk. If a court disposition or police record is not available, you must provide official or certified evidence from the appropriate law enforcement agency or court confirming the record in unavailable. Please note, these documents must either be the original or certified copy.
How to get court deposition or evidence that no charge are filed against this arrest?
I have filed petition for expunging arrest record but that will take a while to conclude.
Please advice what proof I can send to USCIS that this arrest did not even result in charges in court.

Last year my husband got laid off. At that time he was on H1 visa, 140 approved and 485 pending. He applied and got AP, and then left U.S in March 2009. AP is valid until March 02, 2010.
Now he wants to get back to U.S. and try his luck finding a job before AP expires.
My question is what are his chances to be able to get in U.S considering
1)He has stayed outside of U.S for about 11 months.
2)He is not employed by any U.S company.
