LOL, I know. I really regret that I wasn't on these forums years ago, I wouldn't have done so many mistakes. I was thinking "what all these dudes on these forums know? I got a big lawyer with tie and bunch of certificates as best of the best of the best." The life taught me totally opposite.
Except IV all the other forums are in lawyer's websites. So without lawyers we won't get lot of useful info either. But I do see lot of activites in IV forums related to green card than others which is good we are growing on our own :D

I agree and actually this is a time wasting thread. it is good that he got this citizenship and I guess he is happy but what about others who are struggling to get a gc? and this statement really irritated me "I know, the wait time is long, but it is worth it every bit."
maybe they should make new citizens apply for passport every year and tell them to renew DL every year and after few years I will ask him if the wait was worth it ??
I will still say "it is worth it". This is my opinion and you certainly can have a different opinion.
If you think that the GC is not worth the wait then I suggest that you withdraw your I-485 application asap. ;)

I plan to send this petition to all senior executives of Time Warner Inc by Priority Mail and Fax. CNN is a fully owned subsidiary of Time Warner Inc.
http://www.petitionspot.com/petitions/loudobbs
signed.
I agree with some of the posters above that suing will bring attention of the individual as well as general publicity as people will analyze our arguments carefully.
This is one area the IV Core should look at, IMHO

I would think IT experience is the same anywhere so taking it to canada should be ok? If not there are plenty of other management jobs there. It might be a new start but in a one year timespan you will be well established.
Is it just my wishful thinking?
As for masters, are you persuing MBA? How about PMP?
I think US experience will hold good in canada, at at least in IT. Canadian experience matters for immigrants who directly come from their home countries, never having lived in north america before. The trick is to find a good enough job for your experience level .. what is the point of going there and doing the same kind of job that you were stuck with here ?. That is easier said than done given the limited size of the canadian IT industry. I second your thoughts if you do get a good job, an year or so should be good enough to establish yourself. I fact, I know a couple of guys from my area who moved to canada with their families to escape retrogression, and are now well-settled there with no intention of ever coming back to the US. But yes, it took a while for them to find those jobs.

The whole movement against retrogression started only when things went beyond reach.
Yes, we believed in a process and planned accordingly but as we get going we suddenly see that the goal post is not visible anymore, it has been removed and moved far putting us all into a limbo state.
It is definitely our right and not a previlige. When we do not see a goal post and don't know where we are heading we do have right to ask "why and what is the solution".
Though we are not citizens we do have the right to seek a fair system.

When GCSOON-Ihope becomes GC-IgotIt!
Guys, guess what I am holding in my hand? Yes, that bit of plastic, object of our fantasies .and nightmares. After filing Writ of Mandamus on November 1st, things went amazingly quickly and smoothly: on December 1st, the US attorney gave confirmation that the case has been approved and I received the card in the mail on 12/07.
What did I feel then? Really indescribableHappy? It goes way beyond that.
I feel more relieved than anything else, like if I had a ton of lead off my shoulders
May my story inspire, give hope and faith to all of you guys who are so depressed at the moment because of what happened, or did not happen should I say, in that shameful Congress.
As you will see, I had my head in a brick wall more than once. More than once, I was devastated and, still, I never gave up and made it through.
So, please, enjoy the holidays: as long as there is life, there is hope.
I know something about it:
Come here in 1993 as a student on F1 visa. Graduate and got Work Permit (OPT).
Find dream job in dream company. Hired directly by CEO himself.
Company loves me and applies right away for H1 and then Labor Cert.
Life is beautiful. The start of the American Dream. Not for long.
Attorney has been working for company for years. Always successfully.
Picks me for his first failure: screws up completely.
H1 denied. Labor Cert denied. Company gets mad: attorney is fired.
OPT runs out: company still loves me butI am now out of status andfired too.
Welcome to America. Life has turned dark. The start of my American Nightmare.
I am disgusted. Decide to go back to my home country (France).
I miss California. Find new company that loves me: apply for H1 again (this time, I am paying all fees, out of my meager savings).
H1 is approved, got stamp at embassy in Paris. I am back. Life is beautiful again.
Not for long. Exactly 2 hours (no kidding).
Find out that company is a sweat-shop and boss is a crook.
Pays me half (yes, half) what he was supposed to.
Go to INS to complain: If you are not happy, go back to your home country.
I swear that it is exactly what I am told.
Consult attorneys for a possible lawsuit: Alas, your situation happens more often than you can imagine. Many unscrupulous employers use and abuse of would-be immigrants like you. Dont waste your time and money in a lawsuit, just find yourself a new joband be more careful this time.
I am broke. Cant even go back home and anyway I dont want to.
Not with just my tail between my legs for the second time.
Home is here. I want my American Dream and I will get it, no matter what.
Decide to swallow my pride and endure the humiliation until I can find new employer willing to sponsor new H1 and pay all fees. I just cant afford anything as I am hardly surviving.
Employer wants to fire me: you are always complaining about the money.
I have to threaten him (yes I did) to report his company to Dept. of Labor (most his employees are illegals and as abused as I am, not getting paid for overtime and so on).
Imagine in what kind of atmosphere I am workingbut I need this job to remain legal until I can find something else.
For sure, I will be out of there within a couple months at the most.
Dont know yet that this nightmare will last2 years. Still cant believe it.
Had I known, I would have fled the first day, no matter what.
In my specialty, jobs are not easy to find.
Not to mention that this time, I have to be very choosy
Companies that I approach:
a) dont want to hear about immigration or
b) dont want to pay attorney fees or
c) dont want to pay at least prevailing wage or
d) all of the above
All doors seem to be closed.
I have never felt that bad in my life: go see the doctor.
You have all the symptoms of someone who is havinga nervous depression.
Do you want me to refer you to a good psy who could help you?
No, thanks. I know why I am sick.
Finally find new company that loves me: apply for new H1 and they pay all fees.
H1 approved.
This time, I am holding my breath. We are now in December 2000. Seven years since I first came in the US. Time fliesand no GC in sight.
Job is nice, company is nice. Recovering from depression.
Boss loves me: decides to start for me RIR Labor in.May 2001.
Yes, one month after that damn month of April 2001. You know what I mean.
Six months of advertising.
PD is January 2002.
Labor Cert approved in July 2004. Concurrent filing I-140/I-485 in August 2004.
Get EAD. FP in September 2004.
Things change: company is now going down. Boss still loves me butlays me off.
(Re)(Re) Start of my American Nightmare?
Attorney says: Dont worry (!!!) Employer loves you. Wont revoke I-140. GC is for future job. Find new H1 job to maintain status and see what happens.
This time, I am lucky (!) and find right away new H1 job. Company is OK, job is OK.
Later, previous company nicely recovers: got rehired!
Only thing: I will have to pay all fees from now on. Dont care. Back on the right track.
Do Medical in April 2005.
I-140 approved in May 2005but visas are now Unavailable. Nothing to worry about.
October is around the corner and new numbers will be available, right?
Just a few more months and I will have my GC. Wrong.
October bulletin comes out. EB3 World is back to March 2001 (PD is 01/2002).
I swear that I almost s..t in my pants. When is too muchjust too much?
How much more frustration and anguish can I endure? More, much more.
By rage and stress, I pack up an extra 20 lbs in just a few months.
Most people lose weight when they are under extreme stress and/or depression, I do the opposite. I am now 40 lbs overweight.
Second EAD. FP again in October 2005. Life is paced by visa bulletins
September 2006 bulletin comes out: EB3 World has now passed my PD.
I am holding my breath again. Rightly so, for the umpteenth time.
Third EAD.
Wait 2 weeks and start inquiring about the status of my application.
Call so-called Customer service: as usual they know jack s..t.
Your application is still pending. Thanks, I already knew that.
Make Infopass appointment at Los Angeles downtown office.
Sir, I cant tell you anything specific because your case is at the Laguna Niguel office.
Contact them at: CSC-XII@dhs.gov
E-mail #1 on 09/18: () Status of my case? ()
Response on 09/27: the I-485 at question is still pending FBI name check clearance.
Once the file has been cleared by FBI, it will be adjudicated. The service has no control on how long it takes FBI to clear the case.
E-mail #2 on 09/27: () When was that initiated? ()
Response on 10/02: () On or about 08/19/2004. ()
This time, I surprise myself: I am one more time devastated but remain strangely calm.
Even laugh about it. Nervously. Too much is just too much.
I had heard about that Name Check aberration before but had ignored it.
Like most people involved in that GC mess, I refused to worry in advance.
One bridge to cross at the time, please.
Weirdly enough, I am now almost relieved. Why? Because for the first time ever, I can be proactive and I CAN ACT!
I call my lawyer and tell her about those 2 e-mails: Thats good enough to file Writ of Mandamus. That summarizes the whole situation, we dont need anything else.
WOM is filed on November 1st.
(I requested FOIPA and contacted Senators, President, Vice-President etc, etc
only later just in case we would have needed more ammunitions).
After that, things go fast:
11/ 29: without any warning (!), LUD: Your card has been ordered.
12/01: confirmation from the Assistant US Attorney that my case has been approved.
12/04 LUD: Your case has been approved.
(So, they notify you that the card has been orderedbefore notifying that the case has been approved).
12/05: receive Approval Notice in the mail and my attorney indicates that she will then dismiss the Mandamus complaint.
12/07: receive the Magic Card in the mail (regular mail, even not certified, unbelievable).
What a timing! Could I dream of a better Christmas Gift?
Who said Papa Noel/Santa or Banta Claus/Little Red Riding Hood did not exist?
:) ;) :) ;) :) ;) :) ;) :)
HI
Here is a run down on my case:
First I-485 applied in 6/2002,
Fingerprint done, EAD obtained in 2/03
Application withdrawn by spouse due to conviction
Second I-485 applied by my 2nd DW in 7/05
Interview granted in 5/06
Case still pending due name check
GC? till date
Anyone with a similar case and any advice on this case? I've spent about 30K USD on this case on Lawyers and still have NOT got any decision from the USCIS. Now , I'm considering filing a WOM. Whats your take on this? Thanks Guys!

Yes a new memo was issued in 2009 (After DHS confirmed that they have worked with FBI to reduce the response time.) Now since FBI claims that 90/95% of the requests are happening within 6 months. DHS/USCIS is not allowing automatic approval of GC is FBI check was the only peice pending and was pending for more than 180 days.
I went to Infopass today, unfortunately service rep on counter was totally uncooperative. She did not tell anything other than my background check is still pending. It has been pending for more than six months now. I understand that my PD is not current as of yet but, based on recent movement, I hope to have my date current in next couple of months. But, it may not help me much if BC is still pending..
Any suggestions from IV.. What can I do about it? I planning to get in touch with my attorney but, I don't think they can be of much help..

NO point#1 is not true. in fact it is biggest misconception - I remember reading some where that if you have consumed all your 6 years on H1, your extension of H1B beyond 6 years is only based on pending AOS. So in this case, if your 485 is rejected, also your H1B. If you continue to work on H1B even after this, it is illegal.
(This is what I believe & I may be wrong. I am not lawyer, this is not legal advice & check with your attorney first before deciding anything)
Nice. It appears that according to the link below:
http://immigration-information.com/forums/showpost.php?p=18946&postcount=28
The EAD doesn't get invalid when AOS is denied and will be valid till its expiration date.
On the other hand, it appears that there is an advantage to switching to EAD prior to the 6 year H1 expiration to stop the H1 clock. In situation where a AOS is incorrectly denied, a change of status from EAD to H1 for the remainig time can be helpful.
Thoughts?

Could members who had this insurance post their experience?
?
I think your question should be "Could members who had to use this insurance for ER visits post their experience?"
Its good until you file a claim, but you should look for what happens after that.

I am not sure if that is going to be an advantage since my PD was not current in JUNE
who knows? immigrantconnect.com reported that they heard that some applications were approved in june even when the pd wasn't current in that month. i wouldn't worry about it.

If you have health insurance (which I doubt) go to some doc. and get some life injected. That will certainly help you in your current situation and you may be able to jump to EB1.:D

Honestly, these consultants don't even have an H1B worthy job: its not a permanent job offer. They don't get paid fulltime. Let alone their eligibility for a GC ....what a scam!

(translation: sit there like a paraplegic in the line and do nothing ... while a massive line jumping is in process... you will keep seeing while all these EB3 "bodyshopped consultants" will continue to slowly port their PDs and get approved ahead of you.. EB2 I/C is in for a really really long wait.
Honestly, these consultants don't even have an H1B worthy job: its not a permanent job offer. They don't get paid fulltime. Let alone their eligibility for a GC ....what a scam!
We need to let uscis know and audit all current and past approved cases from these consultants)
FYI ...With support from a few people .. we are in the process of filing a Direct injunction for stoppage and immediate audit of interfiled/approved cases. But more support would be appreciated.

Finally, Thank you for your smart and intelligent attempt to dilute the members' focus. First you start off by saying that we have no allegiance to our home land and finally you deduce that country caps are OK.
Inference: You are some psycho who is concerned that the glass ceiling of country caps in employment based system will be shattered sooner or later.
I strongly disagree. He is no psycho, just a juvenile displaying 4th grade logic to exhort the masses. Comes back and 'moderates' his thread by 'channeling', thanking and asking for more brilliant ideas.
nitinboston, do not brush this off as some kind of personal attack and you have bigger fish to fry...I urge you to read and reflect.
This might come as a surprise to some of you, but someone needs to say it out loud. GET A LIFE FOLKS!!!! there is more to life then EB, GC and all. it seem all we desi's can think of is how to get a green card so we can live here with peace and never have to worry bout getting laid off or anything.
Comes as a surprise to your fellow elementary schoolers ? Who are you to generalize ? That is what your immediate buddies or people YOU associate may be thinking.
Few points:
1) having gc is a privilege not a right.
2) US has every right to choose whom they want to have in their country.
Thanks for the breaking news !
4) Considering the number of fraud's committed by Indian body shoppers and people who use them, i am not surprised USCIS is extra careful when it comes to Indian applications. Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing
Does your friend or his wife know what kind of a backstabbing 'best and brightest' you are ? Just because your so called friend's wife got a job cheating (if I take your word for it), it does not give you the right to brush the whole category with the same color. Who are you trying to impress by pissing on everybody ?
5) have a back up. i came here in 2001 as student and have seen it all. I am on h1b since 2004. i knew we have too many people whose sole aim in life is a American GC. to avoid becoming one of those who check processing dates first thing in morning, i applied for Canadian PR, got it in 8 months and i am not even gonna bother applying for labor, i-140 and all those precious life controlling documents.
Wake up friends, you have options. Don't let your life depend on you application status.
Again, thanks for the breaking news and brilliant suggestions. First off, stop generalizing and look beyond your pathetic 'immediate circle'. AND here is some breaking news for you: You have not seen it all, as I can clearly see by the quality of your arguments. Don't come onto a forum, hide behind the curtain of anonymity and shoot your mouth off giving 'plain' 'straight from your heart' BS.

Hello guys please let me know if i am eligible for filing WoM.
My case details are:
EB2, PD 02/12/2002.
I-485 RD: 06/06/2007 and ND: 06/15/2007
I have converted my EB3 PD to EB2. Last month i applied for EAD renewal thinking that it might trigger my GC approval(some people still believe in this)
Today i received my EAD with 2 yrs extension. I consider this as a bad sign because USCIS clearly states that if the visa is unavailable then they will issue 2 yr EAD.
In my case my PD has been current since i filed 485 except two months in this year when EB2 was U.
I have opened 3SRs(on march, april, june 08), went for infopass once, written letters to 3 senators and 2 representatives on july 7th, 2008, sent fax to NSC, also sent letters to NSC and NSC director twice, called NSC several times. I could not get any status update other than the regular response(case is pending and waiting to be assigned)
After taking all these efforts i recently received response for one of the SRs(for june 08) stating these type of cases taking time for approval and i need to wait patiently.
I dont know if i can wait anymore because i have been waiting for close to 7 yrs.
Now in this situation can you guys please let me know what i should do and what should be my next move?
Do you guys think i am eligible to file WoM? if yes please guide me on how to do it.
Thank you so much guys. Looking for some help.

Why don't IV lobbysts take them to nicest Indian cuisine in DC? ;)
Coz IV lobbyists dont have money. Total contributions in last 3 months are less than 5k.

Forum Gurus - I got a denial letter on my 485. I am a July 2007 filer and applied for AOS in July 2007. My 140 was revoked by ex employer in August 2008 and immediately I got a NOID from USCIS and responded to it in a timely manner and my case processing resumed.
But now, I got a denial stating that my 140 has been revoked in August 2008 and thats why my 485 is denied. My Attorney is filing for MTR and says it is a mistake on their side and will be resolved through MTR.
It just baffles me that the person who sent the denial letter never looked into the system to see my case trail and blindly issued the denial notice. My Attorney says, it is very much possible that they do not look at RFEs or responses - they just issue denials when they browse through the 140s.
I am EB2 India with a priority date of March 2006. I think some kind of pre assessment is going on. There are no LUDs and mine is at the TSC.
Is there anyone else in the same boat? How long does it take for MTR to get processed?
