Hi Guys, hellomms and others,
my point is also not nationality. My point is the filed of work and job requirements. since most audit cases end up with questionaire for 'Business necessity', is it somehow connected to DOL definition for each job type...minimum requirements in terms of educational requiremets for that job type etc.. ?
For example: In the IT field , even though your employer advertises for MS and/or experience, but according DOL job type definitions most of the software/computer programmer/analyst job types require a minimum of BS only and or maybe some experience. so is that reason why they are asking you to justify interms of 'Buissness necessity' and hence audited... ? or something else...? I know for sure that some of the science related job types according to DOL need a minimum of MS, ex: parmaceutical jobs, environmental, biotechnology/bioengineering, material science, geoscience etc.

I talked to NSC (using POJ method) and got hold of IO (I am pretty sure it was not the call center representative). He told me that my file is pre-adjudicated and it is on the way to Agent's office for final review. I think that many files are stored at off-site location and are brought back as needed / pd becomes current etc.
He said that all he can do is to wish good luck. I asked him if I will get GC this month or no? He replied that it all depends on how many visa number will be given to them by state department.
It's only day 2 but I feel that they are approving what ever file they have on their hands on. Feels like I will miss this boat too.

My labor certification (Traditional EB-3) is stuck in BEC since last 5 years. It is completely beyond my understanding why it took so long for BEC to process my case. Now everyone is rejoicing USCIS's decision to accept all green card applications, but I am paralyzed with the fear of facing another huge backlog on I-485 applications. One government agency sits on our applications for years and another government agency throws us further back in the line to cover up its blunders and guess what who pays the price: WE RULE-ABIDING, LINE-WAITING FOLKS.
Even if I get my labor approval before September, I will be among the last persons to get labor certification in spite of being the one with the earliest priority date. Nothing would give me greater pleasure than suing DOL BEC at this time. We may not sue DOL on their inability to clear the backlogs, but we can definitely sue them in their utter disregard to FIFO procedures (mind that some people with priority dates in 2004, 2005 have already got their labor certifications, but some with priority dates in 2001, 2002 are still stuck). When I read on their web site that they have tried to maintain FIFO, it makes me feel like puking.
I am also disappointed with IV's attitude towards the backlog victims. I do not remember anything concrete done by IV to address the grievances of backlog victims. Now that they have won the battle with USCIS, will they have time to look at us?

I would like to extend thanks to all of those who shared their thoughts on this labor certification backlog ordeal. I was touched with nice words some of you bestowed on my situation.
The point I was trying to make was that we high skilled immigrants continuously have suffered from the misdeeds of Congress and government agencies. It started in 2001 when Congress passed an amnesty when people in illegal immigration status were given chances for EB Green Cards. If government wanted to legalize them, shouldn�t Congress have created separate processing channel and also separate green card quotas for them? Why were we forced to share our share of green card quotas? Why did we have to undergo several years of grueling labor certification experience to make room for people who violated the immigration law?
Then there was a birth of so called �Backlog Elimination Center (BEC)�. This agency should have been rightfully named as �Backlog Creation Center.� BEC spent several years not in adjudicating the labor certification cases, but in transferring paperwork and performing a circus called �45 Day Letter.� When it finally started addressing the cases, it did with utter disregard to FIFO procedure. As of today, there are still thousands of cases stuck in BEC with priority dates of 2001 and 2002 (including mine). Though they have set the backlog elimination date to be September 2007, there are very strong chances that they won�t. I think life would have better for all of us if no BEC was created in the first place and the labor certification process was left the old way.
The purpose of my earlier post was to draw attention to the severe injustices BEC has thrust on us. The passion and energy IV showed in dealing with the recent USCIS fiasco was commendable. If IV can channel some of that passion and energy in dealing with the BEC problems, we may get some breathing space outside this black hole called BEC.

Alright guys, I cannot tell you how excited I am to report that i got a call this morning from my attorney and my online case status also states that Card Production was ordered for my case!!!
After 8 long years.....i finally have been approved for permanent residency. After 7 years, i will finally, with peace of mind, go back to India to visit my family. Thanks to IV, everyone's help on these forums for helping me keep my sanity over the past 2 years....
After 15 years in the US, I will finally have my green card in hand soon.

Convince your employer and file 485 as soon as possible. With the huge volume of the applications who knows what will happen, they might move the date back again.

Like it or not In legal language you become more so called bright in EB2. If you apply in EB1 you upgrade your so called brightness. It does not matter in reality who you are. But as far as law goes for EB1, EB2 and EB3 etc it prioritizes based on qualifications needed for performing the job function. Our employers and lawyers decide on those requirements. Have you questioned those requirements?
Maybe if we had questioned those requirements laid down by employer and lawyers, more people would be in EB2.
Yes you are absolutely right, had we questioned, then some of the brighter and brightest wouldn't have been legally brighter and brightest (would have had to experience downgrade of their brightness). Most of the brighter and brightest wouldn't have even got into the path / line to become brighter and brightest. Since you are in legally brighter side I am afraid that you won't be able to comprehend the issue and solution of less legally brighter ones.

I just found Feb 08 Stats (http://www.uscis.gov/files/article/APPLICATIONS%20FOR%20IMMIGRATION%20BENEFITS_Februa ry08.pdf) and in Feb 08 there were 787,516 I-485 cases pending. So this might be good news that the backlog is reducing?
Those 197k ( approx ) reduction could be from family based AOS.. until we get data from FOIA , we cannot relay on their information.. Its so broad range of figures they post.
Again who knows when they send us FOAI response.

It is good to see the combined Immigration community efforts are bringing results. However, it appears that no attention is being paid to raise the issue of children ageing out because of visa retrogression and delay in labor clearance. The Child Status Protection Act(CSPA) passed in the year 2002 hardly provides any relief to I-140 based immigration petitions. While for I-130 (for US Citizens) applicants the date of child is frozen on the date of submission of I-130 form it-self, but for employment based immigrant applicants this Act provides a complicated way to calculate the child�s age and it just provides relief for any processing delays in 1-140 clearance only. It just ignores the fact that we have years of retrogression for employment-based category. At the time when this act was passed there was no retrogression in employment-based category and lawmakers perhaps never thought of hardship, which children and families may face because of the retrogression.
We need to raise our voice on this issue too. My son is going to miss out the chance of getting his green card just because his age works out as per formula given in CSPA Act to be 21 years and 12 days � because of 12 days my family may be penalized to be separated from our child whereas no one is going to consider 3 years delay in labor case in my case and then another 13 months we have to wait for filing 1485 after approval of I-140. Mine case was the most unfortunate in the sense that I got my I-140 approval in just 29 days whereas in all cases the normal time is 3-6 months. Had it taken 2 months, my son would have got the benefit under CSPA.
I hope some one from Immigration Voice leadership team will take a lead to highlight such issues also before the law makers.

I have mine sent on 05/06 and receipt notice date on 5/12, routed to NSC. checks encashed after that no update. One soft LUD on 06/07.

According to there are only a few approvals for EB3 ROW in April so far.....
yeah that sucks, but on the brighter side they are processing EB3 PD's for beg and mid 2005.

I guess we have enough people convinced and for those short sighted ones will have an option whether they want to get naturalized or live on their dear GCs so by that time if they educate themselves they will be convinced too.
