    Today I have contacted Ron Gotcher and here is his response.

    1. Begin by contacting the office of the Inspector General of the Department of Labor. That office is supposed to ferret out mismanagement and misconduct within the agency. With cases pending as long as they have been pending, something is clearly wrong.

    2. If you get no response from the IG's office, next prepare a formal letter to the Secretary of Labor, asking for assistance.

    3. If that doesn't work (though it should), next contact the chairs of the House and Senate immigration sub-committees and file formal complaints, requesting their help. If you include a large number of victims, this should impress them enough to contact the agency to find out what's going on and get it resolved.

    And also Ron Gotcher ready to help us.


    So please guys post your inputs and what can be done futher. Its a collective effort and have to help outselves. Here is the action plan.

    1. Rather than every one sending separate letter, let us send only one letter and every one signed that.

    2. Let us create one yahoo group, send all your infomation, Name and adress.

    3. Draft a letter to OIG, attach all our information.

    4. Based on the response let us decide our next move.

    Your comments and inputs are more than welcome..

    Comments are welcome.
    However in order to work on an issue, the push and support must come from members needing it. For that we will need support of Greencard holders who think that this an issue for them and they are willing to participate and support IV to go all the way. Right now we have our hands full with current IV agenda and need to accomplish those with our limited resources

    Enough is enough. I am ready to sign this.

    I have 3 real names. All were working for Cognizant. One had 3 years of exp. Cooked up with 4 years of B.Tech and totalled it as 7 years. Came on L1 as PM and applied in EB1. He got GC in less than 1 year. Other 2 had real 7 years exp and got GC's in 8 months. All were working at Client's place and NOT intra company transfers.

    I am not selfish. But I am sure this guy with 3 years exp may one day become a boss for any of us.

    This misuse will hurt the genuine cases. Shall we we go serious and complaint? I am ready to sign and submit all the proof.

    Actually I have heard of another cognizant case. But that was through a friend's friend chain so I am not sure how reliable it was. But seems like cognizant has been following this practice a lot.

    Thats true..if they are getting GC by wrongly claiming to be qualified for EB1 then they should not be spared..

    Oh..wait..then what about the ppl who cook up their resumes to come here on H1B..who cook up their resumes during Labor process (for GC)..it doesnt matter they end up in EB-2 or EB-3.

    I am not saying everybody who got GC cooked up facts..My point is its bigger than just EB-1.

    If you want to complain then it should be followed for everyone. Lets have a running thread for that, lets make a complaint with all such ppl we know..

    The USCIS and DOS are not answerable to anyone man...they will just streamroll u!!!

    I think, the judicial system in the US is as independent as in India...there is no body under the sun in the US that is not answerable to the judical system..

    Tell me them that even though you are not from the same constituent, the Congressmen will be voting on these bills once tabled in the Congress and you are requesting to support the bill

    I called congressman Hinjosa's office.

    The staffer asked me where I am calling from. Then said you are not a constituent of the congressman and was not willing to transfer to the person who handles immigration issues. I insisted on leaving a message and he took the message, but was surprised, did anybody else encounter this? How do we handle this if it happens with other congressmen?

    Folks, as a FYI, don't get too bogged down with all the details. Here is my status.
    Applied on 3rd march for name correction/reissue of fresh passport.
    1) Got a money order for $60
    2) Filled out the online form
    3) Took copies of relevant pages from passport, license, utility bill.
    4) Signed each copy attesting that it is a true copy
    5) Took a photo from my digital camera, cropped it on epassport.com and got 8 copies for 20 c. It is true that their scanner blurs the quality of picture, so better have a white background.
    6) A couple of email exchanges. This is the best form of communication and I recommend being courteous. Be prepared for vague and sometimes obvious answers.
    7) Received new passport on 30th March, although their website says 7 working days.

    I have never run before............not even a mile. I still cannot and have just started training for the DC 10 miler. So please do not feel shy about running even if this is your first time. We are willing to answer any questions that you might have...........but please signup; set a target and start ASAP. Worst case you will end up walking instead of running.


    That is right!

    You do not have to go out this weekend and test run a 10 mile or 3.12 mile to see if you can do it. If 10 miles is your target, then in training you only have to work up to 7 or 8 miles. On event day, you will have plenty of training under your belt to get you to 10 miles and you will also have race day adrenalin. All of these will help you to walk or run the 10 miles.

    Cheers to everyone who decided not to ask IV to reimburse the fee difference that they paid to Airline companies.

    I was one of the members who bought the ticket early for Sep 13 and had to rebook. Initially, I did ask IV to reimburse me but after receiving a very nice email from Aman and seeing how sincerely they wanted to set things right (regardless of whether I could make it on Sep 18), I never took them up on the reimbursement offer.

    Attending the rally was great! The people who did not come have missed out on a unique experience.

    FP done June 21

    No updates since then.. showing "case received and pending". It's been exact 1 month since FP but there is no change to the last update date. It is still showing June 6th. Any idea what could be happening?

    My dauther is 22 years and 8 month old.
    We have not received an official notification from CIS yet, but she is aged-out according to the way the formula is applied.
    I started my case (EB-3) with DOL in Sep.08,05 when she was 20 and a half years old; My I-140 was approved on Aug.02,05. I had to wait almost 1 year for a visa. On Jul.2,07 I sent I-485s and I-765s. We have received the Work Permits and the apointment notices for the biometrics for each member of my family, including my daughter.
    I live in Falls Church, Virginia, so I went to Jim Moran's office (my House representative) to explain my case, how the CSPA fails and ask him to request CIS to apply the law in a different way (I would say in the right way). I talked to one of his staffers but he said that the law is very clear about the time the case is considered in process (only considers the time the I-140 was in process). As you know, CSPA does not consider the time in DOL nor the time waintg for a visa (retrogression).
    Also my daughter has talked to Senator Webb and he wanted to know how many cases are beeing affected, particularly in Virginia, to see if there are several cases, then something can be done.
    I was wondering if any one has heard about any change on CSPA and if someone know where can I find how many cases are being affected by this nightmare or if someone has started something to have this law be doing the right thing: to protect children and families.

    I have no idea how we can find out how many people are in this situation. From this site alone I think there are probably 'several' of us who would love to share our stories with Jim Moran's office. Surely where we live should make no difference since immigration law is fixed at the federal level.

    I had to wait three and a half years for my labor cert. My son was 18 when it was applied for. I never imagined he would age out. Shows how naive I was with regard to the long labor backlog caused by the 245i mini amnesty of 2001.

    I would be happy to share my case, for certain. It is refreshing to have a legislative office that seem interested and not just give their standard useless replies.

    We should tell our lawyers to post this on their website. Can other Immigration websites post a banner ad about it?

    Yes members can contact their lawyers and other sites to put this information up.
    To add to what Pappu said, some of them might think we are competing for website hits and advertisement. Our main goal is only to get enough volunteers to participate in this activity in DC for their own Green card. Decisions regarding number of volunteers have to be done quickly to get appointments, so send this wherever you can.
    every one has to do his/her part.
