Hi:
I filed on July 23, I-140 and 485 concurrent.
I got EAD on 5th Oct.
I had fingerpring done on OCT12.
Whne Fingerprinting was done, with 2 of my fingers, it gave message
Warning !!!!!!!! Matched (with RED color) . Rest all fingers, it displayed passed with Green color.
Does it mean it matches with some kind of FBI database and Do I need to worry about it?
Please help gurus. I have lost my sleep.

Cool, so thats it, its best to wait for an rfe and respond when you recieve it, if at all
actually that was my attorney's advice too. so u might just be pranoid about ur attorney hate_me :)
i am now of the opinion of doing the remaining parts and holding on to them to be ready whenever they send the RFEs.. no point trying to save some money and risk wasting a window of action when temporarily becoming current.

Why are you worrying much, Why dont you go back to India and come back after one year. Then file for green card. When you do not have project for 6 months why are you worrying for green card?
If you are not married, go back to India find a nice girl get married, enjoy for one yr and come back again.By that time economy will improve and you get project easily.

I received my EAD last month. But no AP yet. However, i received an email from my lawyer that.....my AP got rejected because the rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....
I don't know how to react. The online doesn't have any update about that yet.

Last week lot of people got LUD as 08/05/2007 and no one got any receipts or checks cashed.
I don't think it means anything at this point.

Case 2:
I don't think you even qualify for applying under the case 2 as the labor has aged out. Your I140 has to be applied within 6 months of labor approval.
But as your labor was approved before this came into effect, the last date for applying is Jan 2008. You are fine there.
1. As you say it is a complicated case, Discuss if the ability to pay issues which resulted in 2 denials is worth an MTR.
2. EAD/AP based on filing of case 2 is invalid.
3. Depends on what you are working on? H1b? EAD?
The recent I-140 that has been denied is based on case 2. Though I have multiple labours, I always had one active I-140 in processing. As my H1 was denied and is pending an appeal, I believe my EAD automatically kicked in as that is valid.

Personally I like the idea of not having a comprehensive reform !
Not that I am against immigration reforms...
But i feel it is important to distinguish between LEGAL and ILLEGAL immigration !!!
CIR was a thorn to many -- mostly because of the amnesty... or whatever for the ILLEGALS...
Having a seperate bill/bills for Legal Immigration Backlog clearance is the way to go :)
Brighter chances for it to pass... and that too sooner..

This sounds totally outrageous ! I mean if the company is genuine and no one is on bench etc. what was the ground for deportation ? And what is this about intimidating the immigrant ? What can we do to bring these cases to light and ask for explanations ?

I fear a backlash as by now ewr would have made my company to be marked for secondary scrutiny. this is how the story unfolded

XYZ -- Mr ABC who is based in atlanta ..
CBP. hmmm.. can i have his phone #
CBP calls Mr ABC .. we r deporting XYZ hs papaers r not in order ..
no call back # nothing ..
meanwhile XYZ is asked to sign papers ..
I know we can refuse but those people r so intimidating and I guess if you dont sign ICE agents come in and tell you that it could take months to send you back
so poor xyz has no option but to sign and get a stamp on his passport that he is being deported
Councilor access is a myth and so is trying to call and talk to the CBP officers
and this is not a small body shop .. it has atleast 500 people working on various projects across US and those people were not on bench

I think you can apply for H1 before 12 months but requested start date in LCA should be 12 months from the day you last left US

I am trying to e-file AP renewals by myself instead of using my expensive Attorney. I have a question. If you have successfully e-filed, can you please clarify ?
1)My wife was originally admitted into the US as H-4. But now after entering US on H4 and staying on h-4 for about 6 months she used her EAD to work. Her H4 visa was renewed and is still valid even though our Visa stamping on the passport has expired. So what should her class of admission be ? Should I write H4 or EAD ? AP form asks for class of admission.
2)If filing for both self and wife, should this be mailed in two different packets or one packet , two different envelopes ?

If you are e-filing, by definition you won't need to mail anything (or almost, see below)!
I applied on-line for both EAD and AP, and it's really very simple.
You certainly don't need to pay those ridiculous fees to an attorney for that!
After e-filing, I received two weeks later in the mail a request to send ID pictures. That's the only thing I had to mail.
