We had the same situation with my wife's H1-B. We spoke to the lawyer and he had forwarded us an e-mail reply from USCIS, stating that USCIS had decided to issue the validity of 797 from the date of adjudication or approved date rather than from the previous expired h1B date and this is not happening across all the cases. I also have applied at the same time as my wife's h1 and My h1b dates are matching.

Thank you for the info. Mine is first time EAD and some other members informed that even for the first-time EAD, FP may not be "required".
My wife and I also had our EADs renewed last month. We received our new EADs sometime in the last week of July and neither of us had any Finger Print notices.

We are happy and proud to anounce that we are a 3000+ members family now. Kudos to the all the members for the hard work and perseverance. We are happy with what we have achieved so far and are confident & determined to do our best in the future. I want to quote Sunil on this

Thanks for your reponse Panky... I filed my I-140 cocurrently with I-485 with NSC but it got transfered to CSC ...CSC is not even publishing I-140 processing dates.. Wondering if CSC is processing I-140's... I believe that NSC and TSC has sole jursidication over I-140 adjudication.

Thansk visakk for your reply, I am travelling thru same employer only. He still wants me to come there. Looks like he is confident & is certainly going to give me Revised Offer Letter dated in Feb 2010.
However my main question is still unanswered whether the scenario is correct to travel, considering January 8 guideline issued by DHS/USCIS. And Subsequent Deportation incidents.
I have option to travel on L2 as well. As my spouse is having L1 visa and she is going to travel in March.
But I want to be on H1B, Pleasse enlighten me on this.

Appreciate your quick response. I checked with my travel agent and he said transit visa is not required for Germany. But I am getting different response from some others. By any chance do you know if the procedure still holds good.

I am on a L1 visa which has expired April 2006. I have got my petition extended till 2008. Can I transfer my L1 from Employer A to another Employer B. Can employer B transfer my current L1 petition to his company?

L-1 petition is non-transferable and tied to employer A. However, employer B can file H-1 for you.

MY PD - July 8 2004, RD July 2 2007 NSC. I-485 - Pending USCIS's mistaken with EB Classification. (came to know of this after opening 3 SR's and 3 Infopass appointments).
My Attorney wrote to USCIS last week about the problem with my I-485 (USCIS mistakenly put me as EB3 instead of EB2). I want to know experience of memebers / Attorneys who have writen to USCIS for any reason(s) (USCIS Mistakes, Eb3->EB2 porting, Etc) and goten response and how long did it take for getting the reponse. Any Hard LUDs/Soft LUD's after sending letter etc.
Please share you experience.

i ran my first ad..this sunday..and my lawyer didnt say a thing abt change in perm process.. but he did mention that Eb2 are being scrutinized more.

What is a probable timeline for Eb3 to Eb2 porting ? If we are already using EB3 EAD and not renewed old H1b, is it still possible to apply for Eb2 labor ?

I'm in the same boat as you are and thinking of pursuing EB2 with the same employer as there is a position in the company that requires 9 years of experience and a master's degree. I've got over 13 years of experience and hoping to opt for the EB2 process soon.

You should just provide a valid reason for your case for the senator to help. All senators have direct lines to immigration offices. They can expedite your case and the results are astonishing.
My cousin left to india for an emergency and his AP was pending. Contacted senator and got it approved immediately in a day.
I also heard that one person got his 140 approved in a week. Not sure what reason he provided.
But senators are certainly helpful unlike Indian politicians.
With reference to some one’s case being transferred to the BEC, there are 300,000 other people in the same boat so hold you’re horses.

In 2005 I (american citizen) applied for a I-130 petition for my husband who is an Indian citizen. (It was approved.) Then after that the case was placed under administrative review at the Mumbai embassy in India. It is still pending for over four years now. As of Sept. 2008 My husband recieved a letter stating the petition was sent to the USCIS here for review and possible revocation. We were told to contact them here for our case. They can not find anything on our case.
He is now in Canada on a student visa. Can I apply for a K-3 visa while he is in canada on a student visa? I was told he would need to go back to India for me to apply for a K-3 visa. USCIS agent told me to take the steps in applying for a K-3 visa for him.
