I have just kept GC out of the equation for anything I do in my life. Buying a house was a personal choice and I could afford one - so just went ahead and did it. If I have to leave the country for good due to some immigration related bs, my lender can suck it up :D
You cannot keep GC out of equation when GC/non-GC decides your ability to get unemployment benefits, choice of jobs and many more aspects of your life.
If you leave the country, you lose the equity on the house. I don't know when you bought
the house. In the post credit bubble period, the lender will make sure you have enough equity that they are secure and you have skin in the game.

You should rather analyze how many people from India made innovations like starting a company, a technology, patenting a process etc, on H1B versus on GC?.
Innovation starts when slavery ends. Free thinking and ideas arise often even on H1B, but people can easily act on them when not having to worry about getting kicked out of the country. For your information there are a LOT of companies (and patents) started by Indians who have made it big here. Most of them came on H1B. Similarly there are a lot of companies in the tech area that are starting up in India.
Again best and brightest does not mean innovation and patents alone. It can also refer to the ability to solve existing problems, design processes that need not be patentable.

The points raised are indeed valid and they seem to have a 'case' against us. I do not by any means want to undermine our efforts but it does provide a perspective from the 'citizens' perspective.
The bill would also drastically increase the number of H-1B visas issued to foreign professional workers. As a Human Resources representative, I see first hand how the H-1B visa and employment based green card programs actually work together to drive U.S. white collar workers from their jobs and even from their careers. To begin with, there is virtually nothing in the law that prevents employers from hiring H-1Bers for open positions even if qualified Americans are available and willing to do the work. Americans are routinely laid off and replaced with lower paid H-1Bers also. In these cases, Americans have practically no legal recourse available under current law. H-1B is also a dual intent visa, so an employer may sponsor an H-1Ber for an EB green card for legal permanent resident status. When a company seeks to sponsor a foreign worker for an EB green card, they are required by law to demonstrate a good faith effort to recruit Americans first. This process is called labor certification. But employers routinely game the labor certification process for green card sponsorship to defraud even well qualified citizen job applicants in favor of low wage foreigners. They use fake job ads and/or bad faith interviews of American citizens to convince the federal government that they tried to find American workers first. These practices are common in high tech and even in some non-tech industries, but HR people are told to keep quiet about it or lose their jobs.
I would be in favor of a program that issues a small number of self-sponsoring green cards for truly innovative foreign nationals on a competitive basis. But very few of the H-1Bers or green card applicants that I have seen in 10+ years even come close to being truly innovative. Most are just practitioners with skills that are actually quite common among the domestic workforce. The only thing special about these foreigners is that they will work for substantially less than Americans in order to have a chance to become legal permanent residents. Thus they are used by management to sweeten corporate balance sheets.
The prevailing wage regulations are supposed to insure that foreign nationals are paid the same as their American counterparts in the same job functions, but these regulations are so riddled with loopholes that they are a bad joke.

Most of the folks are missing the point about the prior years approval numbers. All the approvals from 2004 - 2008 are padded with huge visa number from FB spillover and the recapture provision of AC21. From this year onwards we have to live with the usual ~3K per country per category limit. This is the reason why Charles Oppenheim is predicting decade long wait for EB2 I/C and all EB3's. We continue to beat down Oppenheim claim with our own numbers, but he knows more about visa numbers than any one of us.
Let us dream about recapture being a panacea to the problem. There is only limited amount of visa's to be recaptured (~180K) even with that not all categories can become current. Also during that last recapture debates there where lots of suggestions to stagger the usage of recaptured visa over a long time frame like 5 yrs. Even with recapture, the date movement will not be rapid, but it will be remarkably better than what it is now.

USCIS will go according to the ND. They will not follow PD. PD is used only to make the application eligible for adjudication or to apply for AOS. One filed, it is the application ND that takes priority. For example, if there are two EB2 applications, and the PD for the two are Aug 2002 and Aug 2004, and the ND for these two are June 2006 and Jan 2006 respectively, the applicaiton with ND of Jan 2006 gets priority, provided both PD are current.

"I can't think of another issue that could bring together the Democratic Congress and the president like immigration," said Frank Sharry, executive director of the National Immigration Forum, which supports the president's initiatives. "This election has really changed the immigration debate forever."
Pro-immigration groups such as Sharry's predict that the next session of Congress will be far more receptive to the most volatile elements of Bush's immigration plan: a temporary guest-worker program and conditional legalization for millions of undocumented immigrants now in the country.
Since Bush first unveiled his intentions in 2004, those proposals consistently have collided with resistance in the GOP-led House of Representatives, which refused to consider a Senate-passed bill that largely embraced Bush's initiatives.
Now Democrats will take over the House and Senate in early January under leaders who've expressed support for a comprehensive immigration overhaul.

Very unexpectedly, just last year in a hospital, the doctor told me that unless I get operated ASAP, there is not much chance for me to live. As I was still trying to digest that news, I was thinking...
***k the Green card. ***k my job. I just want to live few more years until my son grows to at least 18 (he was just 1-and-a-half at that time).
And I really laugh about the whole incident now. And when I see others vent or getting upset about something, I can't help but get a smile. Because I learnt the hard way that we never appreciate what we have got and always complains about what we haven't got.
It's New Year time!! Enjoy and cherish your presence. And forget about the job/visa for a day or two.
I agree with you Punjabi, I just got an car accident awhile back and thought the same thing like you. even a NORMAL situation is a blessing. we should always appreciate everything that we have and then from there maybe all the things that we always want will come by themselves.

500000 legal immigrants, even if u assume 4 per family , ONLY 125000 houses can be sold...(even if 50% qualify for a loan.. thats just 62500 houses sold.. last i read..there were millions of homes for sale)
if the average cost of the house is 250000, thats additional 31.25 Billion $ in credit borrowing... where is the money?
I agree with you that this is not big enough to stop the entire crisis. But look at the cities where there are lot of immigrants. I can give you one example where it could make huge impact.
Seattle (King County) home of Microsoft has a housing inventory of 8600 single family homes around 1200 condos. It takes 10 months to clear up the inventory.
Microsoft applied around 2K new H1B last year. So my guess is it might have applied around 8k in last 4 years. Lets assume 60% of those didn't GC's. So around 5k people waiting in the line. Lets say out of which 4K didn't buy a house and are willing to buy a house. So 4K new buyers in a market which has 10K units. If every one buys house in next few months then the months of supply will become 6.
There lot of other companies located in this area which also apply for H1Bs.
So the point is immigrants can save or make big enough impact some housing markets.
Revival of housing market revives the economy. May be we should identify those markets and talk to those senators.

What is your take on all these bills.. I am sure you have much more info. Do you see any hope of EB relief in 2009?
There is growing pessimism in EB community.
We have some rough plans for 2009.
We need to wait for some time to see how immigration bill becomes a priority. We anticipate some more placeholder bills that will make a statement. However in the end, there will have to be a bi-partisan effort and strong will to write a CIR. I feel economy will take priority initially but they will have to look at immigration sooner than later. Admin fixes is another possibility we see. While the EB2 India and China are now getting direct benefit from horizontal spillovers, in 2009 we need to meet again with the administration and make a good case about EB3 India, China and EB3ROW backlogs. The problem seems to be increasing due to limited visas per year. This is the reason dates have not been moving. Several Other small items for admin fixes are also in brainstorming stage. Like We want to address processing delays on all applications for all categories, do something to protect the rights of immigrants, etc.
We also want to involve more members who got their greencards or immigrants who are now citizens on IV. We want suggestions from members how we can do that and get their support for this cause.
I am sure with the new initiatives you will love Immigrationvoice more and want to come to IV everyday.
At your end, please try to spread the word about IV. We can be successful in all our initiatives only if we can get more participation. Thus we need to get more EB India, china and ROW members in the IV fold. This must be our top priority early this year before we launch our big campaigns.
We look to members reading this post to help us reach out to their friends and introduce IV to them. We have well meaning intentions for everyone in every category and country and want to help and bring relief. It is important that we come together on IV and make a united effort to end our common immigration problems.

I don't think this is true. As a CSR, case is assigned to you, not you choose the case. I think it's the same way to IOs. PD current cases will be assigned to IO, not IO looks into paper mountains to find case to adjust....

If PD is not current, case is put aside and next file is considered. Due to huge filings in July'07, resultant chaos, and shuffling cases around between centers before entering them in the system, if your file is way below in line (eventhough you deligently made sure to have it with USCIS on July 2, AND your PD is current), no one is going to look at your file, until your turn (in order of final data entry) reaches.

With today's post by a lawyer on DOS communication to USCIS to stop allocating visa numbers to India/China till OCT 1 , 08, it is clear that USCIS will never get its act straight unless we are completely united and press on for a major drive to senators to pass the visa recapture bill ( regardless of EB2 and EB3) . So let us start flooding the senators inbox, voicemail and email with letters urging them to pass the recapture bill. To that extent I request all of you double your efforts. The next session of senate, which starts next month, is a short session and we should act NOW. otherwise nothing will happen until late next year.

gcbikari, the link that you have provided is great, I just looked up a company and saw that the company owner got arrested last week, whom I would have joined. Man, he was doing a sugar coated talk when I was looking for job, and through out his speech he was talking only in millions, like we bought this company ABC last month for 20 million, and in walks in the owner of ABC Company with ragged clothes, really! man who has 20 million.

red splotch for you?? No thats not true... See now you have two greens for defending Franklin:) Franklin (Tamsen) did an amazing job at the rally. No one who has attended the rally has any doubt about it.
ok, that really ticks me off. This post is probably going to get me a red splotch, but you should'nt have picked on Franklin:
I think all the work that Franklin did in preparation for the Rally and then at the Rally itself makes it obvious that she is better than most of the IV members (me included) who could not make it to the Rally.
If you dont like the condescending tone of the voice of someone who has worked hard for IVs goals, feel free to stop coming to IV and posting here. Honestly why should someone here care about whether you like the voice or not when the voice speaks the truth?
Look at all the blog posts and pictures of the DC Rally before saying anything against any of the volunteers who worked at the rally. unlike the people who are "trying to get permanent residency on their own right" these dedicated bunch of IV volunteers are trying to get permanent residency soon for all of us. See the photos, the videos of the speeches and then talk.
What Franklin meant by that post (I think) was that IV is much more than a discussion board for reports of who signed whose Fedex package and what was the timestamp of the package. Its very important that we all actively participate in getting IVs goals met. The rally was a big, for-the-first-time event, and still people seem more excited by tracking receipt notices, and the short-sightedness of it all has made many people ticked off. The turnout could easily have been higher (like someone said, see the lines to the doctors office for getting medicals done when the dates were current, and compare that with how many showed up at the rally).
