How come we didn't have any phone campaign? What were our lobbyists doing?
I'm glued to C-SPAN whenever anything related to immigration is going on in the senate. This time I wasn't aware of it.
We need to be more alert this time. Maybe a phone campaign or web-fax campaign would have turned the scale! We gotta be more alert.

I was at USCIS this morning, followed every thing you suggested. My IO officer was actually a desi guy.
1) They completely refused to look at the received date, I had my EAD (765) receipt, but the IO said he only cares about the receipt date. I even has the print out from USCIS.gov in which they have mentioned that they will honor the date on which applications were received in the mail room but he did not budge. His argument was " That update is in the over all scheme of things, but for EAD they have specific instruction to follow only the date they entered the data in the system"
2) I was not allowed to see a supervisor, the IO did talk to the supervisor but did not let me see her.
So they refused to acknowledge that it is pending more than 90 days?
They are technically right, the regulations say "within 90 days from the date of receipt of the application".
Talk about broken promises. Write to the USCIS ombudsman.

As somebody said above, if we r getting married after Aug 17, and if we decide not to file my 485 now. My PD is May 2007 and my 140 would be approved before my H1B is expired for the second term, and if I didn't file my 485 by then, what kind of H1B extensions would I get ?? 1 year or 3 years.

If you have Citibank account in india, ask your parents or friends to deposit money into that account. Then you can withdraw money in dollars in citibank ATMs at 7-11 here in US since, Thats what i do.

I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.
I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

I "think" that we have had a good number of "new members" signing up for IV in the wake of recent events. And am sure that quite a number of the new members would have started contributing to their own "noble" cause.
Can we have an update from IV core about the "encouraging" number of "new" monthly contributions. Also, this may help make aware others who have joined, who are supposedly unaware of any such contribution.

Folks, democrats are really serious about this bill. This hearing is not at the Immigration subcommittee level instead it is at the FULL JUDICIARY COMMITTEE level. That says, they are really serious about this bill.
Also, in my previous response (quoted below), there is an audio link in which Senator Menendez clearly says something: This bill S 1085 is a pre-cursor to the comprehensive immigration reform. That means, this is like building a border, which is the pre-cursor that anti-immigrants are asking for. Anti-immigrants often argued that, before dealing with the Undocumented immigrants issue, we need to make sure the problems with the Legal immigration should be fixed and the laws should be enforced including border protection. Democrats are using that point to fix the existing problems of the legal immigration system as a pre-cursor to the CIR which will deal with the fate of the Undocumented immigrants.
So, folks even if there is no chance for the passage of CIR this year, passage of a PRE-CURSOR bill is very much possible. Now the Full Senate Committee hearing shows something - Democrats are showing the will to deal with this issue (at least at the Legal Immigration front).
Iron is getting hotter....May be it's just a matter of time to find out when we can strike.
There is so much momentum - I think, IV should join this bandwagon.
If groups supporting employment based immigration like IV are not there to explicitly support this bill, during the mark-up of this bill, our recapture clause could get eliminated under pressure.

Sorry!If it was rude!!No offence meant...Me thinks it is more of a pain than gain!!Like what if your 485 gets approved b4 u file for your spouse's...There are still solutions as much as problems!!It would only benefit guys who are desperate for EAD but then again if you have your I-140 cleard and with serious retrogressions expected you could still get 3 year H1B extensions!!!

I also have a 3 year Bachelor's degree (BSc Physics) + 3 Year masters degree (MCA) from India. I would like to get it evaluated. Could you please let me know which education evaluation agency you used?
Is you bachelor and master degree in the same or related discipline? I read somewhere that the bachelors and master's will have to be in the same or related fields for it to be considered equivalent to US Masters degree.
I haven't seen one 140 get denied due to a 3 +3 education. Any evaluation agency will give masters equivalent. You can use any one of them.

In my opinion, the fear that folks that are contributing 50$ will switch to lower sums is unfounded. There is nothing that stops them from stopping their contributions altogether even now.
yes and people do stop...what do you think...the small minority just keeps contributing when they see others not lifting one finger?
and we are not speaking from "fear of what will happen" we are telling you from experience that people who can afford 50/mnth and are willing to do it are tempted to do 20 instead...and do it. why is that so hard to believe? is it not human? i think it is natural for many to think like that. we have 25,000 members, >90% don't do anything for iv. despite that you won't believe that people will contribute less if they can?
if members really want to contribute- use pay pal and give less. the option is there. why the argument over the set up that iv has made...when you have an alternative??? iv needs to send a signal on what we really need from you and we have done that. the rest is up to you...take a choice. just remember- pay pal takes a chunk every time you do small multiple amounts.
please focus energies elsewhere. this is a moot discussion. and btw your contributions are very welcome- thank you for helping us all in our movement to end retrogression...! you are setting a great example.

Any clarifications why India EB3 is behind mexico?
1. May be there are more Indians in 245(i) cases than mexicans.
2. May be lots of Indians have applied 245(i) cases eventhough they are not illegal. I heard that this is possible and you can use this to any future employer.

I have not filed any AP so far. I am filing it first time now.
Now I have moved to a state which is in Nebraska Service Center's jurisdiction. So should I file my AP in NSC or in TSC?

there is no employment allowed on H4. Please check with your lawyer as you might have problems with canada stamping
she has never worked on H4. The problem is that she has not worked on H1 either and I am thinking of changing her back to H4 to be safe.
within country applying for change of status is not safe, cause she is out of status without any paystubs.
the only 2 choices I see are ask employer to generate paystub and switch to H4 or else leave country and get a brand new H4 on the passport. But was wondering even in this case will they question about previous visa status history or will they just look at my pay stubs so far and grant her a H4.
